How to remove Lis Pendens lien against real properties in California?

Question by little laho: How to remove Lis Pendens lien against real properties in California? My wife's attorney has filed the "notice of pending action" also call "Lis Pendens" against my solely own properties because of the divorce peition filed last year. We are now getting back together and decided to withdraw the divorce petition, however, the "Lis Pendens" is still effect and shows on the county clerk office. Does any knows how to "remove" or expunge it? I am in Los Angeles CA. Thanks.- Best answer:

As a practical matter it's not that important unless you have a pending re-finance; a title examiner will pick up or look for the divorce dismissal. However, one way is to include a notice of dismissal of the Lis Pendens (including the legal descriptions of the properties) with the Notice of dismissal of the divorce petition; sign two originals & file one with the court & record one in the public records where the land is located.

Question by : visitation in prison? I have been the primary caregiver of my two children ages 9 and 11 since birth. I have been divorced for 8 years. I have a very close relationship with my children. There father is going to prison and the court has ordered visitation. I had already offered to take the children to the prison that is far from our home and requires flying, renting a car and staying in a hotel. Even after making this offer, the court ordered the visitation with my ex-husbands sisters as the people to take them. I feel like my parental rights have been violated as I think they should have their mother and support there for these visits. I am shocked that the court would all but cast my role as their mother aside and make this order. Is there any recourse for something like this? 1 hour ago - 4 days left to answer. Additional Details Thank you. I don't know if I'm answering this right. This is in California. He is sentenced in California just outside of Reno but the flight is to Reno to get there from Los Angeles. The sentence is at a minimum security camp and the judge things it is in the childrens best interest to fly to Reno then drive to the prison every 8 weeks for the next two years with extended family who have little involvement in their lives. I am very concerned. They have never traveled without me (let alone to a prison) other than vacations with their dad. I am reeling from court today and can't believe that they ordered this. Especially after I offered to take them 4 times a year, xmas, spring break and twice in summer and more if the boys seemed to need that. This all happened in chambers so I have no idea what was said. As for paying, he will pay if his sisters take them otherwise he wanted me to pay. A very touching situation. However even though you may feel you should be the one to supervise the visits, maybe it's better off for the other party to handle them. Since you have an attorney to help you with this matter and can argue your case to the judge you are in the best hands. Good Luck.

I was adopted at birth, bc my adoptive mother was merried to my biological mothers brother, and she couldnt have kids....I was never supposed to leave florida but my adoptive mom and husband got divorced. So now i live in North Carolina, and im 17. I have met my biological mother, brothers, ect. and i love them and they love me. But here in NC.. My mom constantly tells me to leave, my adoption was a mistake, im a horrible person, im just a fat *****, and i have no ambition, but i know im a really good kid, i dont do drugs, i make good grades, I intern at a elementary school with 1st graders and i know what i wanna do when im older. I just cant take it anymore, i sometimes feel suicidal, and i cry a lot, all i do in my house is get yelled at and we fight. I know suicide isnt good and im not trying to get an easy way out, i just cant deny that it has crossed my mind.. My ex-wife and I were married in Georgia, had two children together, separated, and she skipped off to Florida to be closer to her family. At the time, I been giving her $ 500.00 per week, and had no money for an attorney for quite some time. By the time I had the money, the Georgia attorney that I consulted with, told me that after six months, Florida has jurisdiction over custody, and the fight would be much more difficult. A year and a half ago, I bought a home in Alabama, moved here with my fiancee. My ex and I finally agreed on all the stipulations of divorce. I filed in Alabama a few months ago, she signed jurisdiction over to Alabama, and our divorce was finalized. My fiancee and I were able to marry a month and a half ago. As she does every six months or so, my ex has started issues, making ridiculous claims about the children and their time here, and has started trying to hinder my visitation. Our visitation is mapped out in the decree, the only thing left to Florida was the child support order (which they had no jurisdiction to, I simply had consented to them taking it over the phone). My question is this. Since she signed the jurisdiction over to Alabama in the divorce, can I file for custody here? The children are constantly in unsafe situations there. She has had DFACS involved twice, due to claims of abuse by her oldest daughter, and the kids constantly come here dirty, with lice, with infections, and out of all 6 of them (her and 5 daughters total), there have been three hospitalizations due to Staph, including herself once, and my older daughter the night she was to come to see my wedding. She is very manipulative and conniving. It does not bother her to invent whatever story necessary to have her way so I have to be very careful. She has displayed this time and time again since we split. We are great parents and have two sons living with us now. What will be the best way to approach this? Best answer:

You can reduce the cost of hiring an attorney through preparation and taking the time to interview attorneys. I don't think the VA will allow you to sign over your disability check. That is for YOUR disability and she shouldn't be entitled to it. Disability checks are like Social Security Disability. Why would you give that to someone who doesn't want to be married to you anymore?

Question by super girl: How much will a divorce cost me? I have unfortunately been married since 1989 and we have not been together for almost 9 years. Well upon checking my credit report, I found that I have 2 small items on my report that don't even equal $ 1000. Well I checked his (the ex) and saw that he has accumulated about $ 20,000 in debt with unpaid credit cards and unpaid bills etc. Well these charges have accumulated during the time we were apart. He had gotten his electric turned on in my name at one point and when the electric company sent me a letter stating that they were going to shut off my electric due to non payment at a house that I had never lived in. I called them and explained the situation and have not heard from them since. But on the other hand I noticed that he had filed complaints with the credit company saying he had never lived at any of the houses we had lived in in the past. He lived at every single one. Well the problem I am having is I want a divorce. I want it like I have never wanted anything else. I hate him and wish that he would choke on his own vomit and die. I am sure I will pay more than $ 500 for an attorney but I don't know of any other costs. Also I am afraid that I will responsible for his debt. He had left me on the curb while visiting family in California. He was using drugs and when I told him that I wasn't going to put up with it he left me there and took my kids. I got a job and moved to Pa where he took my kids and fought him and his mother for my kids and got them. He also collects ssi and collects it for the kids as well. He gets it because he is a drug addict. Being a drug addict means he gets to collect money from the government for mental illness. HE SMOKES CRACK AND GETS PAID TO DO IT. I have had the kids for more than 6 years after fighting for 2. I have taken care of myself and my kids ever since. I feel jilted and I feel its all unfair. I don't get child support and I made too much money last year to collect welfare this year. Hm. I have recently lost my job and am collecting unemployment. How is a girl like me ever going to get on my feet? I have worked so hard all of my life to take care of my kids and myself and I get nothing but f$ %@ed. Is there any real advice anyone can give me? I need some real advice. Perhaps from someone who may have successfully gone through anything similar. But really any answers will do from anyone. Best answer:

go to divorcecenter.com they can even do it by mail if they have one in your state.... otherwise you can go to the court house and get papers to do it by yourself. divorce center is about 650 and do it yourself is just court costs.

If I type up my own document stating my exhusband gives me sole custody of our daughter and we both sign in front of a notary will that document be any good if in the future if he tries to take her without my permission. I am just trying to figure out a way to not pay 1800 dollars to an attorney because he is willing to give me custody. Of course the document will include things about visitaion, holidays and such. I live in NC, only have one child and we are divorced. Im asking if he takes her can I use that document to get her back. Will the document be any good for what? If you want something to document what the two of you have agreed so the two of you can consult it then sure. You don't even need to notarize it. If you want to use it to legally enforce something then you'll have to go to court anyway. The fact that it's notarized will not bind the judge though.

My husband and I have been seperated for nearly two years, but haven't gotten a divorce yet because of finances. I dropped my kids off with him at his parent's house (he's on probation for larceny) to stay with my father for three days until he passed away at his home. That day, he calls me furious because he recieved a letter from NC Child Support Enforcement saying he was $ 2300 behind in support and he would be taken to court if it wasn't paid (and since he was on probation with no job, that means jail). He demanded that I somehow drop the order (I can't because I'm recieving federal assistance- single mother of two who just escaped a domestically violent marriage!) and I explained I'd be more than willing to have it reduced from $ 580 a month to $ 100 a month, just enough for diapers, but that a judge wouldn't drop it completely. He was mad, and said he'd do what he had to do, which I took to mean he'd file a motion to have it dropped. The day of the funeral, I came home to find out he'd taken out a restraining order on me that very same day, alleging that I was suicidal and wanted to kill myself and my children because he wouldn't pay his child support and because my father was dying. (I took his death very well, it was his decision to come off of life support, and I respect that.) These words were never even thought about by me, let alone said. I have witnesses to attest to the conversation about child support and to summarize my "emotional state" throughout that whole week while my father passed. I cannot see or speak to my babies, who are two and three. I go to court Wednesday to defend myself, but because I don't have the money to hire an attorney, I'm afraid I'll lose my babies. This is serious. He has since paid the $ 2300 in back support but the state won't release it because the kids are in his custody now. (The domestic violence order of protection he took out on me gave him emergency custody). Any pointers on how to defend myself? This man was convicted of domestic violence towards me when DSS found bruises all over me when we finally seperated. I don't know what to do, what to expect. I'm so heartbroken- these are children, not a ball to be passed back and forth! Any case studies of abusive men who file false charges against their wives to avoid paying child support? Any help is more than appreciated. You all don't know how much of a relief it is just to hear people care! Legal Aid of NC won't help me because I'm a defendant in this case, even though I'm a battered spouse. Also, he told my mother that night that he didn't want custody, he intends to give the kids to his parents. It's all over child support. How horrible! He's now also alleging I'm placing my children in an unsafe sexual environment because he supposedly has seen bondage toys and a dog cage in my home. Absurd! Truly low! Like I said, if anyone can help with advice, it's more than appreciated. There's a hole in my chest where my heart used to be. Seperating a mother from her babies is beyond inhumane. Best answer:

Wow what a horror story. A truly narcissist trick. I can't give you legal advice, living in the Netherlands, but I do wish you luck. Tell them how it is. It's your only chance. Maybe there's an organisation for battered women that you can consult. I'll star you so maybe one of my contacts will come up with a better advice.

I am fully willing and able to pay whatever child support that is required. Honestly even if my wife wants full custody/no visits that is fine. I just want to get divorced as soon as possible. Both my wife and I work so I don't think I would owe any alimony or anything. I don't think I can be happy married and I need to be free. Would I be able to leave the state freely if I wanted to after the divorce? How soon can I be divorced? - Not children. Just the one baby. I feel like its better to leave now rather than have regrets. I get that its not perfect but it is what it is. - Honestly divorce is the best for everyone involved. I am not cut out to be married. Yes. If your friend is incarcerated, his attorney should be able to provide him with the proper paperwork to allow someone else to pick up the vehicle if it has been released from police custody.

My husband and I have been seperated for nearly two years, but haven't gotten a divorce yet because of finances. I dropped my kids off with him at his parent's house (he's on probation for larceny) to stay with my father for three days until he passed away at his home. That day, he calls me furious because he recieved a letter from NC Child Support Enforcement saying he was $ 2300 behind in support and he would be taken to court if it wasn't paid (and since he was on probation with no job, that means jail). He demanded that I somehow drop the order (I can't because I'm recieving federal assistance- single mother of two who just escaped a domestically violent marriage!) and I explained I'd be more than willing to have it reduced from $ 580 a month to $ 100 a month, just enough for diapers, but that a judge wouldn't drop it completely. He was mad, and said he'd do what he had to do, which I took to mean he'd file a motion to have it dropped. The day of the funeral, I came home to find out he'd taken out a restraining order on me that very same day, alleging that I was suicidal and wanted to kill myself and my children because he wouldn't pay his child support and because my father was dying. (I took his death very well, it was his decision to come off of life support, and I respect that.) These words were never even thought about by me, let alone said. I have witnesses to attest to the conversation about child support and to summarize my "emotional state" throughout that whole week while my father passed. I cannot see or speak to my babies, who are two and three. I go to court Wednesday to defend myself, but because I don't have the money to hire an attorney, I'm afraid I'll lose my babies. This is serious. He has since paid the $ 2300 in back support but the state won't release it because the kids are in his custody now. (The domestic violence order of protection he took out on me gave him emergency custody). Any pointers on how to defend myself? This man was convicted of domestic violence towards me when DSS found bruises all over me when we finally seperated. I don't know what to do, what to expect. I'm so heartbroken- these are children, not a ball to be passed back and forth! Any case studies of abusive men who file false charges against their wives to avoid paying child support? Any help is more than appreciated. MG- Thanks so much. I'm so distraught! There's a hole in my chest where my heart used to be! I tried to get phone records, however, the company won't release them without a court order. It's such a horrible mess. And, I just learned he's accusing me of placing them in an "unsafe sexual environment". He alleges he saw me in a dog cage and practicing bondage in my home. What an outlandish accusation to make against a mother! Caodhen- I've been reading as much. This is insane! I've found a lot of info for men who have been wrongly accused, but none like my situation. I feel bad for men in this situation, I truly do. I hope that written statements from witnesses will be enough. First, I have just survived your situation and I know how hard it is! I had joint phys custody but left the state with my children to get away from the domestic abuse and start a new life. My x agreed to the move and said it would be a good break for the kids. He even helped load the Uhaul! After I filed back support he filed a parental abduction on me (even though Id been gone 6 mo). Please know that you can defend yourself, try to stay calm and get witnesses of your mental state and the system will work. Its just so hard when you cant see your babies! The judge will be fair to you and will see what your x was trying to do! Hang in there!!

Superior Court Judge Frederick C. Shaller issued the ruling after a two-week court hearing over the parental rights of Abbie Dorn, a 34-year-old who is being cared for by her parents at their Myrtle Beach, S.C., home. The order will stand until a trial date is set in the case, said Dorn's attorney, Lisa Helfend Meyer. Dorn's parents, who are suing for permanent visitation, want the children to visit for two weeks every summer and a week in the fall and spring, but an attorney for Dorn's ex-husband argued during a hearing earlier this week that their mother was so badly injured giving birth that she is no longer capable of being a parent. A call to Vicki Greene, the attorney for Abbie Dorn's ex-husband, was not immediately return a call Friday. During the hearing's closing arguments on Thursday, the attorney for Dorn's family said that although Dorn may be incapable of taking part in a traditional mother-child relationship, that doesn't mean she should be shut out from holding her children, watching them grow and bonding with them. The tragic events that led all parties to Shaller's courtroom this week began on what should have been the happiest day of Abbie Dorn's life. That was June 20, 2006, when she left for the hospital to give birth to her sons Reuvi and Yossi and their sister Esti. The first two births took place without incident. But as a doctor was delivering Yossi, he accidentally nicked Dorn's uterus. Before doctors could stop the bleeding, her heart had stopped, a defibrillator they used malfunctioned and her brain was deprived of oxygen. A year later her husband, Dan Dorn, divorced her because he believed she would never recover. He is raising their children at his Los Angeles home. Meyer complained that during a December visit, when the children asked to take home a photo of their mother, Cohen gave them each framed pictures that they clutched tightly. These things take time. They have to find him, wait for the judge to set a date, do background checks and check into his finances, that takes weeks, compile all the information, and then look up laws to see what's fair to ask for, then you get to go to court.

I want to discuss Kurt Cobains murder....thats right MURDER I want to tell you all the facts i have to prove it wasn't suicide... 1. IF Cobain injected three times a lethal dose of heroin, COULD he then pick up a shotgun and shoot himself? Wouldn't he have been immediately incapacitated? Based on the heroin, (morphine), blood levels found in Cobain's body, preliminary research indicates Kurt Cobain would have been almost immediately incapacitated. He could not have picked up that shotgun. He could not have pulled that trigger! 2.The note found at the scene by the police was immediately labeled as a "suicide note." The police report states it was "apparently written by Cobain to his wife and daughter, explaining why he had killed himself." But this note was not addressed to Kurt's wife and daughter and it says nothing about "killing himself!" This note was clearly written to Cobain's fans telling them he was quitting the music business. There was only a short footnote to Courtney and Frances and the handwriting contained in those lines has been questioned by several handwriting experts. 3.The shotgun found at the scene was purchased BEFORE Cobain left for rehab in Los Angeles, NOT AFTER he fled the rehab as reported by misinformed media sources. 4.The police claim there were no legible fingerprints on this shotgun! 5.Courtney knew Kurt wanted out of the marriage. Just weeks prior to his death, she asked one of her attorneys to get the "meanest, most vicious divorce lawyer" she could find. 6. As mentioned earlier, the entrance door to the greenhouse had a push and twist lock. Anyone could have locked it and pulled it shut as they left, so Kurt was NOT barricaded in the room as the police had indicated to me and as the media had reported. 7. Even if he was considering a suicide, the evidence shows that someone beat him to it! But I don't think he had any suicidal intentions at this time, the facts show that he had too much to live for and was making plans for his new life after the divorce and getting custody of Frances Bean. 8.The suicide note, the last five lines did not match his handwriting. He never mentions suicide in the so-called suicide note." 9.Tom Grant( Courtney hired to help find Kurt) explains why: "The first phone call to me began with a lie. When we met with her at her hotel, she continued lying. She told us about stories she had just planted in the press. She seemed extremely manipulative and dominating. She didn't seem so concerned about what was going on with him, although she said he was suicidal and everybody knows he's going to kill himself. Yet she seemed more concerned about her career than anything else. 10.They have evidence based on the leaked autopsy report that we received saying, someone gave him an overly pure dose of heroin, waited until he was unconscious and made it staged to look like a suicide. Tell me what you think? Even if you dont like Kurt Cobain...noone deserves to murder and get away with it.... yeah i too believe kurt was murdered but at this point why badger the topic. you have to think about poor frances. imagine how she would feel having her mother accused of killing her father. proving that psycho bitch killed kurt wont bring him back to life and lets face it he would have ended up dead anyway, either by real suicide or drug overdose.

What's fair alimony for an uncontested divorce in Florida?

Question by Guy B: What's fair alimony for an uncontested divorce in Florida? Since it's uncontested that means her and I have to agree on an amount. Child support is not an issue since that's set according to a table in Florida. Let's say I make $ 100,000 a year (just a round number for this illustration). We have two children so child support would be $ 1,500/month. She hasn't worked in 11 years but has a degree so she could get a decent job. Based on that, I was thinking $ 500/month for alimony and it diminishes $ 100/month each year so the second year it would be $ 400, the third year $ 300, etc. and ends after five years. Is that reasonable? If it went to a judge (contested) what do you think they would award? I know all the stories about people "getting screwed" by the judge and all that but I've talked to attorney twice last year and he said the laws are more in favor of the non-custodial parent now than they used to be. And that the court considers her "potential" earning power instead of the fact that she's been unemployed so long. Positve feedback only please. Save the sarcastic replies for someone else. Sounds more than fair to me. What would be more fair is if she found employment before the divorce and supported herself. I can understand child support payments but there is no reason for alimony.

Question by Dan S: Can I contest a divorce decree that I signed 9 years ago? In 1999 I was legally divorced from the mother or my daughter. At the time I was 22 years old and just out of the Army. I had no legal representation and signed the agreement that was presented to me by her attorney. I recently reviewed this agreement as it pertains to child support. I noticed that the section referencing the length of time that I will be responsible for paying support stated that the payments will continue past the age of 18 as long as my daughter is attending any continuing education. According to the below PA law do I have any recourse to fight this? Since I signed the divorce decree can it now be amended? In Pennsylvania , child support is payable until a child reaches eighteen years old or graduates from high school, whichever is later. (The Pennsylvania Supreme Court declared that parents cannot be forced by a court to pay for college expenses of a child unless the parent has signed a written agreement providing for college support.) However, a duty of support may continue beyond the age of eighteen, if a child is unable to support himself or herself because of a physical or mental disability. The amount of child support that is payable in a case is based upon the monthly after tax incomes or earning capacities of the child's parents. Best answer:

My husband I went for a adjustment of status interview December 7th 2010., and I 'm not sure how it went. It was a very short interviewer.The interviewer didnt ask that many questions, she never asked to see our pictures, or anything like that.It started off withthe interviewer questioning my husband about his previous marriage, and questioned him about his petition with to his first wife which was denied.He said he did not know.She then questioned him about his arrest in 2008 for a misdemeanor conviction.She then asked him his name, birthdate, and she took all of his documents and then questioned him about how did he meet me.I left to use the restroom, and when i came back she asked me where did I work, how much did I make per hour, when did I start my job and that was it...the interview probably lasted 15 minutes, ... Our attorney asked the immigration officer if she would like to see photos,the officer said no.She then stated they would need to review our case furthur and we should recieve something in the mail within 30 days.well 3-0 days passed, and January 10th my husband went and paid a visit to see where was his case, they explained to him that they were still in need of more documentaion, and it would 30 to 60 more days.My husband was able to find out that his first wife withdrew her petion during their green card interview during seperation(yes they were seperated at the interview), but the reason is unclear. we dont know what she said, or what the scenario was, that made her withdraw,So due to his anxiety and frustration, he has me taking him to to go see a different lawyer everyday to consult on what could happen, and I am getting frustrated as well, because this is all he talks about every day...so now hes made the decision to get rid of his current lawyer and hire a different lawyer to take his case,(even though case is still pending) and so he went down to immigration on friday(Feb 11) to see what was going on with his case, and another officer just old him that his case is in "coninued action department" and she would talk to the officer that handled his case tommorrow(Monday) which would make 60 days, to see what is going on( is this a good idea?Does it sound like hes petition could be denied? Additional Details sidenote:he was convicted of a misdeanor(rental fraud).. another sidenote:okay, he married his first wife (Jan 2008) arranged indian marrriage, they petitioned in Chicago, Illinois, she lived in chicago, he lived in Los Angeles,(where he attended school, on a school visa) they 're change of adjustment of status interview was in Nov 2008)they were seperated during the interview, her parents faxed him a letter a month later, from immigration sating his I 485 was denied, but they never let him know theyre daugher withdrew her petition,( after the interview they never spoke again) in May 2009, his first wife filed for divorce, divorce finalized October 2009, he was put into deportation proceedings, we married November 2009, his deportation case was thrown out July 2010, interview December 2010... Our attorney asked the immigration officer if she would like to see photos,the officer said no.She then stated they would need to review our case furthur and we should recieve something in the mail within 30 days.well 3-0 days passed, and January 10th my husband went and paid a visit to see where was his case, they explained to him that they were still in need of more documentaion, and it would 30 to 60 more days.My husband was able to find out that his first wife withdrew her petion during their green card interview during seperation(yes they were seperated at the interview), but the reason is unclear. we dont know what she said, or what the scenario was, that made her withdraw,So due to his anxiety and frustration, he has me taking him to to go see a different lawyer everyday to consult on what could happen, and I am getting frustrated as well, because this is all he talks about every day...so now hes made the decision to get rid of his current lawyer and hire a different lawyer to take his case,(even though case is still pending) and so he went down to immigration on friday(Feb 11) to see what was going on with his case, and another officer just old him that his case is in "coninued action department" and she would talk to the officer that handled his case tommorrow(Monday) which would make 60 days, to see what is going on( is this a good idea?Does it sound like hes petition could be denied? Additional Details sidenote:he was convicted of a misdeanor(rental fraud).. another sidenote:okay, he married his first wife (Jan 2008) arranged indian marrriage, they petitioned in Chicago, Illinois, she lived in chicago, he lived in Los Angeles,(where he attended school, on a school visa) they 're change of adjustment of status interview was in Nov 2008)they were seperated during the interview, her parents faxed him a letter a month later, from immigration sating his I 485 was denied, but they never let him know theyre daugher withdrew her petition,( after the interview they never spoke again) in May 2009, his first wife filed for divorce, divorce finalized October 2009, he was put into deportation proceedings, we married November 2009, his deportation case was thrown out July 2010, interview December 2010... wrongful property lien in arkansas?

Question by Claudia A: wrongful property lien in arkansas? I got a divorce in Arkansas in 1994, my ex was supposed to sign a quit claim deed to the home. I recently paid the house off a couple years ago, I had to move to NC and was renting it with an option to buy. The renter moved out and I am trying to sell the property. When I talked to the title insurance company, they informed me that there were two liens on the property. One was a tax lien on my ex-husband filed in 2003 and another from a car accident he had in 2004. Now I find that he never signed a quit-claim. I hired an attorney to clear the home and we got paperwork from the IRS stating that due to a statute in Arkansas law, they have no interest in the property since in my divorce, I got sole ownership of the home. However, the lien that stemmed from the accident, they won't clear, stating that I not only owe them for the lien amount, but $ 4k in interest. How would I go about getting this lien released since I was not a party to the original lien and wouldn't the same statute the IRS quoted, be applied to this case? Shouldn't my ex should be held liable and held in contempt for not executing the quit-claim as was ordered by the judge. I'd really like to have someone weigh in on this. If you hired an attorney, then why are you posting this question on Yahoo? Isn't this something you should be asking your attorney? I can weigh in on at least one thing: YOU are responsible for ensuring you get a quitclaim deed. A deed must be literally given to you. If you did not have a deed in your hand in 1994, then you should have dealt with it in 1995, not 2012. What is the statute that the IRS cited? "A statute in Arkansas law" is quite vague. How about being more specific, such as Arkansas Code, title 5, chapter 8, section 202, or whatever. One thing you could do is pay the lien yourself, and sue your ex. But my guess is that if the victim of the auto accident had to resort to placing a lien, then it means your ex had no money to pay the victim, and probably still has no money now.

My friend's husband has been cheating on her for a long time, and she has forgiven him and gone back numerous times, but now she is done. They are currently stationed in NC since he is in the Navy, but she is currently in the processing of buying a house in Arizone where she wants to take the kids with her. Currently her husband's name is in the paperwork to buy the house, but he is working with lawyers and realtors to get his name off because he doesn't want her to go and take the kids...they have yet to have the final house inspection so he should be able to get his name off without too much of a fight, and then she will no longer qualify for the house loan, since she has no income. She doesn't work. ANYWAYS...she wants to move to Arizona, across the country, with the kids and stay married to her husband. She wants to wait to file for divorce so she can still be covered by insurance...but she expects him to pay $ 700 (BAH) each paycheck... They currently have a house on base, so they do not get BAH but she has a general power of attorney for her husband so she plans on getting out of the lease without his permission so he can give her the BAH and he will move to the barracks. Is there anything he can do??? Is this legal??? She is my friend but I completely disagree with what she is doing. I dont think they belong together, but I dont think she should take his kids away, whether he cheated or not. She says its not fair for her to have to stay here in NC, but its not all about her, the kids need their dad. @Mare Ummm...this is my friend and if this is at all illegal she can get in trouble, which I dont want for her! I know how to get my passport (but don't know how much it will cost)...but how do I get a copy of my divorce? Divorce records are public records in the court of the county you were divorced in. Call the NYC clerk of the court; they can direct your to a webpage or a person who can advise you the bgest way to obtain the copies there; should be no big deal.

LEGAL question about annulment?

Question by : LEGAL question about annulment? My husband of 3 years has just informed me that he isn't sure if he is divorced from his ex wife. She disappeared him years ago and he never filed for divorce. He doesn't know if she ever filed in another state or not. We do not know where she lives or her current last name. He have tried to search for her with no luck. A) How do we find out if she did in fact file for a missing person divorce in another state? B) If they are still married, how do I go about getting my marriage to him annulled? We were married in TN, but reside in NC. We have a son together and I haven''t been able to get any attorney to return my call! When we got our marriage license, he told them about the previous marriage, but they did not ask for proof of divorce. At that time, he told me he was divorced. It wasn't until now, 3 years later, that I find out that he isn't actually sure that he is. I would have never married him without making sure it was taken care of, had I known! Best answer:

Im not sure about the laws in TN but if its the same as here, your marriage would automatically be void if in fact he is still married. Before you can even get married, if you've had a previous marriage you have to tell them that and provide a copy of the divorce decree. Alot of states even have a time requirement that must pass before you can get married again.

I don't want to break up my family, and I have tried just about everything, counceling ext... but she does not even try to make it work. I told her If that is what she wants I will take 100% responsibilty of or 3 year old son. all she has to do is support herself. we have about 10,000 dollars in debt, witch she should be half responsible for. We have been married for 6 years, and she has stayed home with our son for 3. I wish we could work this out, we had a good marriage, and I love her more then anything. I don't want to fight over my son, both are good parents, and want to raise and see him as much as possible. but right now I am looking for advice if we do divorce. Best answer:

Well I was thinking and I realized that I do have a week and a half of paid vacation so I could technically drive up and get her next weekend if she agreed to this. However, if I do bring her from NC to TX, we will need to find a lawyer or something to get a divorce in the works, and keep her husband from finding her. It was a very short interviewer.The interviewer didnt ask that many questions, she never asked to see our pictures, or anything like that.It started off withthe interviewer questioning my husband about his previous marriage, and questioned him about his petition with to his first wife which was denied.He said he did not know.She then questioned him about his arrest in 2008 for a misdemeanor conviction.She then asked him his name, birthdate, and she took all of his documents and then questioned him about how did he meet me.I left to use the restroom, and when i came back she asked me where did I work, how much did I make per hour, when did I start my job and that was it...the interview probably lasted 15 minutes, ... I hope your husband just doesn't hire any attorney. You need to find one that specializes in immigration. There are those who used to work at Immigration and they are the best as they know all the "ins" and "outs". I did find such an attorney and it made it easy for me in the past. Good luck!

Q&A: Do grandparents have 'visitation' rights in a non-divorce situation?

Question by bccrupert: Do grandparents have 'visitation' rights in a non-divorce situation? My husband and I are still together, divorce is not an issue nor is there any problems in our marriage. What is the problem is the one set of grandparents to my children (my husband's parents). They are upset because they want to be at our house every moment they have 'free time' and aren't out with their friends or at some social gathering that they are always at. They have quite an extensive social circle and are the 'social butterflies'. We, however, refuse to cancel our plans to accommodate their busy life when they have time to see the grandkids. We aren't going to call them and see what their plans are before we make our own, nor should we have to cancel ours just because they finally have time to be here. The problem is, they say they have certain 'grandparent rights' in the state (PA) and they are talking about getting an attorney to go after set visitation times. Can they do this? I know in divorce situations they could, but we are together, and they do get to see the grandkids. Everything I found online is for divorce situations, and this is not. Can someone please let me know if there is anything they can legally do here? Best answer:

They have a right to see their grandchildren but that doesn't necessarily mean that they can control your life to do it. I'd talk to a lawyer just to see the details of the law.
