Any Wisconsin family court/child custody experts out there?

Question by pinksk8ergal: Any Wisconsin family court/child custody experts out there? Tale as old as time... My new husband is previously divorced with 3 great kids (ages 13, 10, 9). Mom has placement, with dad only getting the kids on his 2 days off/week. Kids constantly complain about their home life and ask when dad is going back to court for new arrangements. We're a little worried because mom is pretty unstable, unreasonable, likes to slap, constantly ranting and raving at the kids and us over petty things, disregarding the divorce stipulations and has a history of bizarre behavior. Dad would like to go back to court for at least 50/50 custody, but his attorney is advising him to wait until the divorce is 2 years old and until he is working 1st shift. I don't know if our situation is favorable to us possibly getting placement or "more" custody. We both work 2nd shift at a PD in the city we live and are home during the day for the kids, the oldest is 13 and if there is a crisis at home, we (and grandparents) can be there in 3 min. So much really depends on the judge. I assume that there was a Guardian ad litem that represented the children and made her recommendation. As such, I would trust that her opinion will not have changed in the recent future, and, the judge will most likely uphold the previous ruling. The reason that you are being advised to wait until you are on first shift is simple: the judge probably won't order the children to go to daycare (or non-biological grandparents) when they could go home to mom. Wisconsin does favor 50/50 placement, and it is usually ordered. If you were to go back to court because of her "behavior issues", you would need to request a psychological evaluation. Your husband and yourself would have to comply, also, and, they are EXPENSIVE. Please remember though, that children at this age complain. They may be complaining to mom about you and your husband as much as complaining to you about her. The children have lived with the mother for 13 years. They have an established home/ routine at her house (good or bad). Judges don't like moving children out of there home, or away from their primary caregiver. However, the older child is of an age where she could talk to the judge and he could consider her opinion. It doesn't mean that he will do what she says, but, he has the option to talk to her about it. Ultimately, I would trust what your attorney says. He is familiar with the case, and, with the judge. Judges tend to have a pattern of rulings, and, if your attorney is competent, he will be able to tell you when to file, or, when you are spinning your wheels. Lastly, I would urge you to keep a record of any erratic or unstable behavior. If you can show a year long log of complaints by the children, her not coming to get them or leaving them for extended periods, or whatever the case may be, it can work in your benefit. Also document what the children are saying may be going on in the home. While you may be the new wife and loving step-mom, (I mean no disrespect when I say this) but, the issue is between mom & dad. Often times well intended step-parents can be seen by judges as trying to undermine the natural parents decisions. I know it is hard to "step back" when you love these kids, but, I suggest you try to. Overbearing (and I don't know you, so, you probably aren't) stepmoms cause more problems than help in court. My sister's attorney and her ex-husbands attorney both suggested that the new spouse stay at home. I have heard several attorneys suggest the same thing. Good luck!

I have been seperated from my husband since last April...and in SC you have to be seperated a year before you file for divorce...unless you do legal seperation. My husband filed for divorce at his attorney's office...I dont have one, or not yet anyway. Well I went to pick up the papers at his attorney's office yesterday...and I have no clue about this whole thing so I just signed what they gave me. Well...on his amended complaint it states that I should be responsible for reimbursing the medical insurance that he has had to pay for me since April, 2006 since his insurance carrier would not let him take me off until the divorce is final. So like I said earlier I signed these papers, not knowing what they said. Well I have been paying my own insurance since then...and I had no clue that he could not take me off...I just don't feel it's my responsibility to pay that...I just don't know how bad it is that I have signed the papers...I have done an amended answer...how much is that goin g to help me though? I'm just really scared...I don't know how much his insurance is with me on it...and his lawyer is being a real jerk now that he knows I'm going to amend the answer...but he's not helping me anyway. And please don't give me a lecture about "you should not sign without reading" I know this...I just never thought he would do this. I gaurantee if I thought he would have been trying to take more from me I would have, but I just thought he was better than that. I mean it's already paid for why does it matter, right? And I just feel it's his responsibility, regardless if we are seperated. Best answer:

Question by Kay Kay: Military mom that lost custody of her son? Hi, I'm from charleston sc, and that is where I filled for divorce. My ex-husband gained custody of my son bc im in the military. I currently pay him $ 800 in child support every month. So what I'm asking is if anyone knows a good attorney in Charleston SC willing to do whatever it takes to help me get custody of my son. I'm willing to do whatever it takes to get him back. I think it is wrong that I lost my son bc of the job that I have. I know that I can provide a better home than his father. interview with at least 3 different attorneys and find one that you are comfortable with and who has positive experience in helping women in your exact situation. also, make sure that your attorney is going to work for YOU...not necessarily what HE thinks is best. Best wishes!

Have you been to court and the judge signed the divorce decree? If so, then yes, you are legally divorced. It doesn't matter where you got married, where you got divorced, or who has (or has not) paid the lawyer.

Uncontested Michigan Divorce?

Question by TeKi: Uncontested Michigan Divorce? My husband and I have been separated for 1 year. He lives in SC (in military) and I moved to MI 1 year ago. In SC you must be separated for 1 year to get an uncontested divorce. He could technically file in SC now however, he is military and did not let them know we were separated and continued to receive extra dependent pay for me for the past year. So now he wants to go through MI so that he won't have to pay all that money back. My question is this..he keeps putting the divorce off now. I am READY TO MOVE ON! I just don't have the money to file myself here. Anyone have any suggestions? If I still lived in SC I would just go file through the military for free but with being so far away I don't have that option. I know NOTHING about MI law and am very skeptical about seeing an attorney here. I want to make sure I am getting the best advice not just someone wanting to make some money off me. Thanks! if they have a legal aid why don't you call them if you don't got income it's no fee but if you do they go by income i don't know nothing about Michigan

Well Christy, your husband is out defending you and me while you are living in a poor me world. Yes you can get an online Divorce but this seems way too sneaky. Is this true that while he is gone away, you want to take his daughter and hook up with another man? I can't see how you and your daughter can make it while you are in school. Florida Divorce Question?

Question by Ultimate Warrior: Florida Divorce Question? My stepdaughter and son-in-law were married about 5 years ago while he was in the country illegally. After some time and after the birth of their son, they agreed that it would be best if he obtained legal status, so he was required to return to his country (Mexico) and wait while the immigration process ran its course. During that 20 month period their relationship was strong and she visited him in Mexico with the child several times. Only a few months before he was to return (October 2009) she met another man and cheated on her husband, and she has maintained this relationship to date. When he returned with as a legal US resident she kicked him out of the house. He had no money or job at the time. My wife and I took him in of course and he has been living with us since then. He has been working sporadically. I'll skip all the mean and lousy things she has said and done to him, but it should be noted she was recently diagnosed with Bipolar Disorder. She is only reasonable once in a while. She is a Registered Nurse and makes decent money (perhaps 60k/yr). She does have 2 other children (11) from previous married (she receives child support from their father) and owns a home, but is upside down in that home. A few days ago she filed for divorce/dissolution, sent him copies of the paperwork and asked him to go to her attorney's office to sign. Most of the terms are standard and reasonable, including shared visitation of their child and a division of assets, but some modifications are needed. Also, she would keep the house, and she is requesting $ 400 a month child support. While my son in law is completely willing to support their child and would be happy to pay even more if he could, he simply does not have that kind of money. He is living with us, works as much as he can which varies a lot, and as a house painter is not making much money. He is in no position to pay very much in child support until he can save some money, get out on his own, and obtain steady work. We know we can use the Florida Child Support worksheets to have the amount modified, at least for now. The big questions we have are: -Now that she has served him with the papers, what exactly must he do to have changes made? Keep in mind, neither he nor we can afford an attorney, at least not more than a few hundred dollars, perhaps for legal assistance. -Can he deny her filing and file a petition on his own? If so, can he sue her for Infidelity and obtain any compensation from her (again, he may not do that, but we want to know what the law is) -Is there a time frame for him to respond, and if so, what is considered a "response"? Can he refuse to sign the divorce papers and not have it go into effect by default? What other advice can you provide? Any assistance you can provide would be helpful. Thank you. Best answer:

You can go to the county in your area and get a free attorney there. You just need to fill out some paper work and submit some stuff in order to get a free one. you can file a modification of support. Each area is different so go to the county and find out your rights. The worse thing you can do is not show up. Show up and be honest. Yes there is a time frame and if you don't show you will lose all your rights. I say go fight and tell the judge what happened. if you have any questions im on yahoo

We do have a child right now but have worked out custody on our own. I want the most least expensive option whether it be through an attorney or doing it myself. He left me with all the household items and property and has taken what he wants. it should be pretty easy, I just want it filed and done with. Anyone know a good cheap attorney or how I can file. The easiest and least expensive way to file for diovrce is to make it uncontested (agreed upon). You can do it yourself, you don't need a lawyer unless its contested. Ass marital assets will be split equally depending on your state. Not all online divorces are scams, I used a document prep service and was incredibly pleased with it, just do your research and only use one that has a good rep and offers a guarantee.

Question by MightyKumquat: huge divorce mess, can anyone help? I have a friend who is having a really hard time. He has been trying to divorce his wife for the past 2 years. He joined the military a few years ago, stationed in florida when she pushed him to marry her during a visit out there. she went back to their home state of wisconsin to live. he then got stationed to texas. although they never lived together, he bought her a house in wisconsin (where he stupidly has the mortgage under his name but the deed is under both their names). she then proceeded to cheat on him while he was away. obviously, this marriage was a disaster to begin with. luckily they have NO kids together. after a years of this, he filed for separation, which she agreed to. then, he filed for divorce and she has been using stall tactics to prevent them from getting a divorce. he has had his lawyer serve her papers 14 times and each time, she has come back asking to change a term here or there, or agreeing to sign the papers if they call off the hearing but never signing the papers or she's requested a trial by jury (which would cost him thousands more, but her nothing since she doesn't have a lawyer). she actually called him once and laughed saying she will never give him a divorce - this while she is still living with the man she initially cheated on him with. now, she is saying that she will sign the papers if he pays off her $ 2000 credit card debt. of course, he doesn't trust her. my friend is now stationed in hawaii and knows that he can try to file again under hawaii laws as soon as he's been a resident for 6 months. but the question is: what happens if she still refuses to sign the papers or keeps trying to stall for more money as she has been doing? anyone have any practical or legal advise for handling this? it's been a nighmare for this my friend. he paid his attorney $ 4000 and got no results so he's really concerned that it will be the same in hawaii. key divorce points: married in florida, husband lived in texas and currently in hawaii, wife in wisconsin. no kids. 1 house that is currently under market value with husband's name on mortgage and both names on deed. hey mike, yeah, it does seem like a crazy story and i wish it was all fabricated. however, i've seen a few of divorce paper copies that his attorney sent him when they served her so i know he is trying. btw, i'm his best friend, not his gf. although his gf is thinking about dumping him over this. His divorce would be much simpler if he gave up all his assets and moved on. This is how I divorced btw, and my life was much better. My gut reaction to this is that he has a girlfriend, presumably you, and he is feeding his gf lies about the divorce so he can stay married and have a piece of @ss gf on the side, hence the delayed divorce. If I were to give his gf advice...I would say...no divorce= no sex.

Educated guess- $ 1500-$ 2000. IF he doesn't argue about anything!! The minute you start to fight, the money amount explodes. ps- I don't think anyone read your question! You already tried to do it yourself... :) At least contact an attorney and pay for a couple of hours of his time to get it done right. A serve by a licensed process server is usually $ 50-$ 150, depending on how many times they have to try. If you know where he is and they can find him in the first pass (works from 8-5, etc) that will keep your cost down. The one guy is right, could you wait until your child turns 18? Would make it much simpler.

Any pointers? - You bet, hire a good lawyer. A good lawyer is expensive, lack of a good lawyer is even more expensive. A wise man once said "If you think the cost of an education is expensive, you should try the cost of ignorance" Look for legal aide societies in your area. By the way, you are already in trouble. There are no defendants in divorces. There are petitioners and respondents.

First of all, if you have a great local lawyer, please make sure you do it all where you are - but don't necessarily file first. The automatic response of a lawyer far away, on behalf of your husband, will be to request it to be done there. If you don't have a lawyer there or you don't want to travel then ask for your husband to file first...The first person that files has less chance of getting it done where they are. Sometimes a lawyer will travel for your case, but that is very expensive. I'm separated, living separately, waiting for him to file...I totally understand.. I'm sorry for your loss.

My wife filed for divorce and her attorney filed a motion to seal the divorce details which includes a provision that neither of us discuss what the other person did. I do not want to be prevented from talking about it so refused to sign the divorce papers. So what happens now. Can she still divorce me if I don't sign? He has lied to me on who he is, and it seems like once the ring went on my finger the true him came jumping out. Question by : If I need to file contempt in the county where my divorce took place? I was a wisconsin resident when I had my divorced filed in IA. The reason it was filed in Iowa, was my attorney said I wasn't a resident in WI long enough to file here. Now I need to file contempt against him for back child support, unpaid medical bills, division of property etc... does this need to be filed where the divorce was filed or can I do it through the court house here where I reside. Problem with filing back there, would be hard for me to go back and file during hours court house is open. I'm a full time student and work part-time, so my schedule doesn't really allow for me to just take off and go back during weekday- this is several hours away from where I live. and is there a time limit in which to file for things such as property division? Uncontested Michigan Divorce?

Question by TeKi: Uncontested Michigan Divorce? My husband and I have been separated for 1 year. He lives in SC (in military) and I moved to MI 1 year ago. In SC you must be separated for 1 year to get an uncontested divorce. He could technically file in SC now however, he is military and did not let them know we were separated and continued to receive extra dependent pay for me for the past year. So now he wants to go through MI so that he won't have to pay all that money back. My question is this..he keeps putting the divorce off now. I am READY TO MOVE ON! I just don't have the money to file myself here. Anyone have any suggestions? If I still lived in SC I would just go file through the military for free but with being so far away I don't have that option. You should've already gotten your copy. If he filed, they (he) sends you a copy to sign. You dont just get 1 copy and take it to the other to sign.. somethings up so if I were you... I'd tell him no. Tell him your going to file yourself and he'll receive a copy IN THE MAIL.

First; the deed is called a 'quit claim' not 'quick'. A POA can be used in almost any circumstances provided it is is legally drawn and witnessed appropriately. Of course, this must not be an attempt dis-en-franchise her from any financial settlement. Failure to recognise this aspect could cost you dearly if this action were seen to be so. You should address this problem with a lawyer for your own protection, let alone your wife. Especially since it forms part of a divorce settlement. Good fortune whatever path you take...

Divorce question and custody in pa?

Question by Ginger: Divorce question and custody in pa? Due to financial matters I can't move out of the house that I currently own with my husband. Thus, we have marital property and also have a four year old son. We have left everything for the courts to decide, including custody of our child. Although I live with him, we do not talk unless it is in front of our son. We basically "live there" but we do not associate with one another. we each have our own jobs and go out with our own friends. For holidays we see our own families and take our child with us. There really is no relationship left to speak of anymore. We file for divorce back in october 2008 and have not heard anything from the courts or the attorneys. I heard from a friend that because I still live with my husband (even thouh things are strained between us), that our divorce won't be granted. But I've also heard that this is becoming pretty common these days. I was just wondering if this was the case. Leaving the court to decide how your live should be after a divorce doesn't sound very wise...and living together in your situation doesn't sound healthy for the child..or for people who cannot get along together nor agree on anything with the divorce

FLORIDA DIVORCE QUESTIONS(military)?

Question by : FLORIDA DIVORCE QUESTIONS(military)? If I believe child support is not being used like it should can I demand from the courts that my ex spouse show proof each month to me how child support is being spent? Also, I am in the military station in Colorado and filed for divorce in Colorado. My ex moved to Florida 2wks after I filed for divorce in Colorado....she in returned filed for divorce in Florida 1 month prior to her being a Florida residence which is 6 months. Is there any military law that excuses spouses from having to change their residency???? Her attorney is trying to say that is why she can file before she is an actual resident. Right now my Colorado Attorney is fighting that Colorado be the primary place for the divorce and jurisdiction. Best answer:

No, you can not have her proved what child support is being used for. And I keep telling you she is a resident of Florida. Get over it.

Like can it be done in ink or does it have to typed? Are there additional forms i need that arent included in the packet you buy. I bought the lawpak for ohio. I live in Meigs County. Sorry to hear that you are having a hard time. I filed myself in Missouri and all the paperwork was there that I needed. They even had a class that you could go to for help to fill out the paperwork. do they have any organizations in OH that have lawyers that will answer questions for free such as legal aide?

Problems filing for child support 12 years after divorce, what do I do?

Question by peggy m: Problems filing for child support 12 years after divorce, what do I do? What do I do to get child support from my ex-husband. Divorced July 1995, Illinois. Very violent man. No-show divorce judgement, also meant child support not decided. Left it open. Moved to Wisconsin. Son in hospital for diabetes, no insurance, applied to public aid to help with medical costs. They said had "good cause" not to pursue father for child support (1997). Got a job with insurance. No more state aid. Years later (today) job cuts pay, cost of living goes up. I go to Wisconsin child support agency to file for an order to get child support. They say go through Illiniois. Illinois says, not a resident, go through Wisconsin. Have no funds for an attorney. Son's medical expenses each year are more than my annual salary (that's with insurance!) but I make just over the income limit for assistance. Now kids want college in the near future. Any suggestions? For those of you telling me to go to court, I kind of already figured that one out on my own. Problem is which court? Wisconsin has no jurisdiction over an Illinois resident and I am not an Illinois resident! Already been to both! Best answer:

Question by Feroze R: what kind of proof requires to be a florida resident? i am florida resident for 20 years as i own the property.now my son who mostly deployed overseas,he has property in MD and basically he is a MD resident.now from his job and promotion if he has becomes florida resident he may get some tax Relief.i live half of the time with him and half of the time in florida.he is a very loving and caring son and even though i have two daughters but he is the one he takes care of me.his love for me is unconditional and i want to die living with him,so i decided to put his name into my property deed but it will be my biggest mistake to add his name just because ha has fathered a child,just for dating the girl for 3 visit, whose mother hide the baby from all of us,for i.5 years, and when she can't afford then she went for child support so my son went for his dna and all the required proof and have to pay a big chunk of child support and the mother has not given his last name and she do not wants to have any thing beside the child support,my son was quite that the baby was breast feeding and we never intended to snatch a baby from the mother,as in my daughter's divorce we have seen all the drama how badly the baby girl was traumatized when her father forcefully took away the baby when she was 3 years old,because she never known her father,but her father to punish his wife with the court order suddenly show up and took baby for a week,if he would first familiarized with her for few hours and then took was not a shock to the girl who never known her father,now she is 7 she hates her father but she developed how to manipulated parents to make them happy and get what ever she wants.i am telling this just u guys to understand the situation and the complication for every person's deed,it starts nicely whether a marriage or a baby or money or property,but if any thing goes wrong or against the will of other partner then it becomes very ugly. i love my son and i am not going to take this property in my grave, which is paid off, and he is the one who paid it off 12 years ago,and my son is the only one will get it when i die. i decided not to put his name on my property deed instead to make him a solo owner i will have a will for him.just because he might get married and his future wife she is a very nice well educated girl,but she is 17 years younger with him and have a lot of her parents side and grant parents side property and wealth that she and her Brother will have,they both are in love and she love him i think more than my son,( but as i said every thing starts nicely)as compare to my son he has every thing but every thing on loan,but a very good paying job,through which the mother of his baby will drain him out for the child custody battle,the baby loves his father and i know he will never miss his mother whatever visitation time court will allow him,but the mother of the child told him this last visit that if he thinks she will let her child away from her sight that will never happen,so in this kind of situation i do not want we all go homeless and every one knows how much attorneys take advantage of this kind of case to squeeze money no mercy. now what other identification or proof he will need with out a property in his name in florida,beside, registration for vote, a florida driver license,in which he can give his address to my home as he can live with me? i want all the right information to gather for im as he will have one week off to show his move to florida, some one said he will need two utility bills in his name that will show his residency to this state,the bills are in my name solly,and if i let him have my electricity bill will be only one piece of evidence i can let me have my phone but i use cell phone so i do not have any land line,can he have the water bill changed to his name that can be second required proof, but to change the electricity and water bill to his name, is it going to effect my benefits from this property? as i get homestead exemption and widower discount on my return and from next year i may not even have to file a tax return as i do not earn any thing beside a small social security pension which is less than $ 900/year. since half of the time i live with him so he do not charge any thing from me so i easily just pay my property taxes and all the bills from my pocket. i hope some one out there will read it and understand the long story of my concern and the as a mother to her loving sun to pay him back to help him to get any benefits from me from his tax saving or any thing that make him to change his residency to florida. i need a clear legal 100% sure answer.no guess.person who knows the florida law and want to help me by understanding my situation and my son's need,please let me know as soon as u can.specially what and how to start,water and electricity in his name?can i add him on my bills will be good? He's since refused to pay all bills(our home is going into forclosure & we're being sued), cleaned out our bank accounts, shut down my business & attempted taking out loans in my name. Spending his time slandering me, hurting me & running up more attorney fees just to get even w/me for leaving. He's prolonging the divorce & intends to keep all our assets & leave me w/the debts. He's gainfully employed while, I'm working part time because I decided to better myself & go back to school. filing for divorce in Michigan...what are the steps i need to take?

We are doing an uncontested Divorce, with A MINOR CHILD, with no attorney... What papers or things do I need and where do I get them...Clerks office no longer gives you the paper work. they said you have to get them from targetinfo.com and this cost $ 47. Should I do this or should I go to the library and have them printed. Should I try for legal aid...will this slow the process down? ANY HELP ADVICE OR ANYTHING WOULD BE GREATLY APPRECIATED!!! Friend going through Ohio Divorce/Bankruptcy?

Question by coconuthead508: Friend going through Ohio Divorce/Bankruptcy? My best friend is going through a divorce/bankruptcy. The bankruptcy is going through first - filed the joint paperwork with the attorney yesterday. Their spouse is letting their house go into foreclosure (3 months late with payments); however, already has another house lined up for to move into. Performing an auditor track on the new house, the auditor's page shows the spouse's father making the recent purchase and owning the house effective 10/20/2008. I'm sure there is nothing wrong with this since the house is not in the spouse's name (YET!!). Spouse is asking for alimony from my best friend however; he lives pay check to pay check, up to date and keeping current with child support (even though there is no court order). Can anything be brought up in bankruptcy / divorce court? Thank you for your help!! Best answer:

Question by : my dad molested me when I was a 5-10 years old, now I want to seek justice? My dad sexually molested me when I was a little girl, 5-10 years old. It was bad, but the reason why I never told anyone was because he said it was our little secret, and I was just a child, I figured something was wrong but wasn't sure. My mom was also never around with her working and my two older sisters. but now that I am 17, I have known I should do something about it for 2 years, but I still was just to afraid, I threatened him once before that I will go to the court, but he said I would go to jail because there is no proof. But recently I found a little black book I wrote in when I was like 7, I have one paid that said "daddy said to come over there so he can pinch me, I'm afraid of daddy" I wonder if somehow the court could use that, and like make sure i really did write it when I was 7 and I didn't like forge it. and another is he lives in chicago, and this all happened in chicago, but I live in california. I can't get an attorney because I have NO money. since my mom and I moved when I was 11, he hasn't paid any child support in like hmm...6 years. I need the money, but my mom doesn't have money to get a divorce attorney to get the child support. He now has been dating this chick for over a year in Chicago, she has two kids under 14 and they both have a baby on the way. He is still LEGALLY married to my mom. I haven't spoken to him much within the past 6 years besides a hand full of times and once when I brought up the sexually molestion that i remember. I am wondering if I go to the court or a police station if I have to pay someone for advice and if he can go to jail even though it was 7 years ago. and about how I can get child support for the 6 years he hasn't paid for me. And if he does end up going to jail by some divine miracle, if the courts will make him pay me every month for back child support. Thanks. Best answer:
