Q&A: Can you give me some advice on my parents divorce?

Question by drifter: Can you give me some advice on my parents divorce? So... my parents are getting a divorce. Its just so frustrating. I hate my father. Its his fault. I don't know what to do. I keep yelling at him and running from home to my friends house. I'm scared and hurt. And I feel like its all my fault! What can I do? I just don't want to feel this anymore. I'm just so...I can't even describe it! Can you give me some advice? Best answer:

Answer by Cigar Man
First, realize that the divorce is between your parents and is in no way your fault. Second, it sounds as if you are taking sides. Be neutral if possible. Third, speak to your school counselor about where to get help to talk through your emotions.

Question by Alex L: My ex is suing me for my military pension=:-(? We were married for 6 years, then legally seperated. I filed for divorce, which took another 6 years. All this happened over the span of 12 years, while I was in the Army. I live in Los Angeles, California. She is suing me in a CA court, through a local attorney, from Ohio. Nobody seems to know what to do with the case, who has jurisdiction, how to calculate percentage, and the attorney fees are mounting. Why a Pre-Trial when we agree on everything?

Question by JamesF in the US: Why a Pre-Trial when we agree on everything? I am going through a divorce in Ohio. Short version of the story is that my spouse and I, through our respective lawyers, have agreed on child support, parenting time, etc. What my attorney called "Temporary Orders". That has been filed with the court and the required support payments have started coming out of my check. Can somebody please help me understand why we are going to a pre-trial when there are no outstanding issues. i.e. we agreed on debt, assets, holiday schedules, everything. Nobody, including my attorney can give me a clear explanation about this. Best answer:

Answer by CJ
Judge needs to be informed, formally for the record, on all dealings and how you will proceed.

Legal Advice on Divorce in Texas Concerning Child Support?

Question by : Legal Advice on Divorce in Texas Concerning Child Support? My friend is going through a divorce. It will be over Sept. 8th. His ex got a lawyer to draw up the papers. He received his papers yesterday and they set his child support at $ 600.00 a month for 2 kids. They didn't even ask for his pay stubs or call his work to see what he makes. Is there any way he can get this changed before Sept 8. How is the amount for child support set? Who does he need to talk to in order to get this lowered a bit? Best answer:

Answer by La Vie Boheme
$ 600 for 2 kids is not a lot. I know that in NY, child support is 17% of the salary. My S.O. pays $ 700 a month for one child. All you can tell him is to Google TX child support calculator.

Ohio law regarding moving out during divorce..?

Question by : Ohio law regarding moving out during divorce..? I inherited before marriage the house my husband, kids & I live in. I meet with my attorney in a couple days to discuss everything but I was just curious. Is there any legal way to get my husband to leave before the divorce is final seeings how it could over a year or more from now? I have two young children that find it very confusing why we dont talk & why their dad doesnt come home 5/7 days of the week until they are in bed & they dont get to see him. He doesnt help with anything, wastes my household stuff that I have to buy and doesnt pitch in with anything. I have to beg him to watch the kids for a couple of hours in the evening so I could go to the grocery alone. Tonight I was gone for about 2 1/2 hours & my son was up past his bedtime playing alone in the dining room.. Asked Husband if he had ate & said No because my 3 year old didn't tell him he was hungry? Two loads of laundry to be done & he picked out his clothing articles & washed them.. Wont take out trash or obviously take proper care for the kids.. Oh & of course there is no financial help either. Isn't there anything that can be done? Best answer:

Answer by Unforgiven
Shae your concerns with your attorney but you may need to accept a compromise in the absence of any domestic violence.

A NC divorced guy's ex has agreed to give him custody of their child. Can this be done outside of court?

Question by Jess: A NC divorced guy's ex has agreed to give him custody of their child. Can this be done outside of court? I know a guy who has just recently gotten divorced. His now ex-wife has agreed to give him custody of their oldest daughter. How does this need to be taken care of in the state of North Carolina? Can this be done outside of Court, or does it still have to go before a Judge to become "legal?" Are there documents that need to be completed? It just seems to me that, since both parents agree, this should be easy to take care of... ? Neither parent has an attorney, and I don't think either parents can really afford an attorney. There needs to be something in writing, however, just in case a problem arises. Thanks for any help! Best answer:

If you were to give your best advice to the kids about to go through it what would that be? Best answer:

Answer by sheloves_dablues
Deal with your own marital shi1t. The kids didn't create it, nor can they fix it. Divorce if you have to but leave the kids out of it. Mom and dad aren't doing this "to" you, they are doing it "for" the family.

Virginia Divorce│Can I Get Him To Pay For The Divorce? by Virginia Divorce Lawyer

www.virginiadivorceattorney.com The law in Virginia certainly allows the court to make an award of attorneys fees in favor of either party. It is an issue for the court, it may be done in a preliminary stage of the proceeding or it may have to go forward at a final hearing or in some circumstances, maybe reserved for a hearing after the conclusion of the divorce litigation itself. In the circumstance where the parties have come to an agreement, it is quite common that both parties will agree that they will pay their own attorneys fees and this is part of the agreement and negotiation process. There is case law in Virginia that reflects that if a party is awarded spousal support that the court should make some provision for the payment of attorneys fees by the support paying party. That law has been in effect in Virginia for about 30 years and while it has obviously had some bits of pieces and circumstances in which the court found it inappropriate, the general proposition is still good law. The court will usually consider the reasonableness of the parties and whether or not issues that ultimately are litigated have in fact been properly litigated, that is to say that there is such either a complex issue or that the matter has to be dealt with by the court as a matter of complexity that the matter would then have to be determined. If that court makes that finding that the matter needed to be determined by the court, then the court will generally not award either party ... Video Rating: 0 / 5

Q&A: Pennsylvania Divorce Law - unsigned papers?

Question by TryingMyBest: Pennsylvania Divorce Law - unsigned papers? My friend who lives in PA filed for a divorce from her husband in (I believe it was) 2004. It refused to sign the papers because there was a line in there about the PFA that she had against him, and because he wanted it in the papers that she left him for her new bf even though she had not yet met her new bf when she told him she was leaving. They have a child together, but have their cutody issues all figured out. Any assets or personal property they had together she told him what she wanted, but also told him the divorce was more important so just give her what he wants and keep everything else. e has never given her anything, not even her own clothes, shoes, books, journals, electronics, nothing, in all this time, but she is willing to look past that, and had even told the judge that during the one court hearing they had years ago. She does not have an attorney, and can not afford one. She is disabled and has 5 children to care for. He has not signed the papers, and has not counter filed. Nothing has happened with this in years. I heard there was a paper you could file in PA to request a hearing for the judge to make a decision on the divorce if more than 2 years had passed since the initial filing. Her husband has told her he will sign papers now as long as he does not have to do or pay anything. Does anyone know what this paper could be and how to get it? She has tried calling the court house and they are being clueless. What can she do to get this done without a lot of expense or attornies? Best answer:

Answer by MontrealGuy
She needs to contact a social services office and ask for help. They usually have lawyers who will take the file on legal aid or pro bono (free). She can also contact a shelter for battered women and they can refer her to a lawyer. If one or all of the five children are from her husband then the court will order him to pay child support regardless of what he wants. If the husband works, then in many cases the lawyer can even ask the court for the husband to pay her legal fees considering that he has been acting in bad faith all these years. And if he has not been paying anything for the kids all this time, then they can even force him to pay retroactive the day he left. And if he does not, he will end up in jail. At the very least your friend should explain this to him and ask him to cooperate to avoid serious problems. All the best

"simple" divorce in Florida, paperwork question?

Question by IanP: "simple" divorce in Florida, paperwork question? Your Open QuestionShow me another » Question on self-filing divorce docs.? I'm drawing up the papers for "simple dissolution of marriage" in Florida... there are two "financial affidavits"- basically His and Hers. in the section where you have to list your assets, do I have to list hers, as well as mine, on my affidavit, checking the "husband" or "wife" box next to each... or do I just list my assets on my affidavit, and hers on hers? Anyone else been this route? Tips appreciated... this is expensive enough already without hiring an attorney to fill in a few forms Best answer:

Can my attorney sign my divorce papers?

Question by : Can my attorney sign my divorce papers? I paid my attorney on June 9th to file a very simple uncontested divorce. (It now has been 3 months since I paid him) After nothing being filed after 2 months, with the advice of the SC Bar, I sent him a certified letter dismissing him as my attorney and requesting that he return my money. I had already left him a voice mail and email stating the same thing. Of course, he never picked up the certified mail. I filed the divorce papers in the courts on Aug 25th. Sent them to my spouse and already recieved the "green card" back from the PO. On Sept 2, I get a call from this attorney stating that he filed my paper that day. Question is...............How did he file these papers without my signature on anything? How was he able to file a duplicate divorce? Does he need my signature to file? What can I do now? I told him that I already contact the Bar about this and he laughed at me and said they are not going to do anything. And also told me that I was very bossy and that is why my husband left me. Little does he know why "I" left him 5 years ago! Thanks for nay help with this matter. I will be at the court house Tuesday as soon as the doors open to see if I can close the case that he opened! Yosemite............Thank you for the insight. But I never signed a single piece of paper with him. Any idea on how I should proceed. I think he is a fly by night attorney. No office only a PO box address. Best answer:

Answer by Yosemitesam
If you sign legal papers giving power of attorney and the attorney signs "proof of power" the attorney should be able to sign.In fact anyone not just your attorney should be able to sign as long as you give them power of attorney. As long as they sign showing "proof of power"

Q&A: I have been hit by Virginia Child Support Enforcement based on the Mother's Affidavit.?

Question by Struck by VA Child Support Enf.: I have been hit by Virginia Child Support Enforcement based on the Mother's Affidavit.? I retired in 03 and had my child support adjusted in Virginia, I now live in South Carolina. I have developed Osteoarthritis in Both Knees, had Surgery on both, developed Diatetes and take Insulin and have other medical Problems. I had to file Bankruptcy in 04, Chapter 13, to pay debits where I housed, fed, clothed, payed Cobra, and helped the mother of the children sue her job for sexual harrassment. I was married and this was an affair. I never, ever missed a child support payment or payed less than court ordered until 07 when I lost my job over my kness. I went on unemployment for 7 months till I could get TWO partime jobs. The mother agreed to take less until I got better employment. I was terminated from on part time job again, for knee problems and not being able to walk. I have never went a month without paying some child support, I love my children and know they need money to live also. The mother went to VA DCSEA and filed an affidavit. Based on her statements, they have garnished my wages, revoked my passport and sent letters to the IRS, Federal and State of SC to send them my refunds. There is more action that they can and will take and I can not afford an attorney. I have called DCSEA several times and get treated like a dead beat Dad and plainly told, pay your child support. They refuse to answer my letters, I sent one Certified, Return receipt requested. They got it but did not return the receipt. I have searched and searched for legal assistance, it all seems to be for the Mother and none for the Father. I have filed for a copy of the Affidavit because she or VADCSEA is claiming I owe 17K in AARES and 3K in back support. They even refuse to explain to me what the AARES is and are charging me 3% interest on it. I was divorced in 05 and live alone. Is there anyone who can suggest help for me. I worry about loosing everything and it would never pay what the claim I owe. Best answer:

Poor Credit Loan Needed to IMMEDIATELY pay off back child support to avoid jail.?

Question by maggieeld: Poor Credit Loan Needed to IMMEDIATELY pay off back child support to avoid jail.? My husband is in arrears in child support, $ 8,500.00. I want to get a loan so that I can pay off this debt and he can catch-up. If you want an explaination of the situation, read below. Otherwise, here are my criteria: We do not own a home, we rent. I have a home-based business so income is harder to document for me than others. I own a car, it is only worth about $ 1,000.00. it's a 1996 Mercedes E320. I also have a 2000 Honda Passport however it doesnt run. Both are paid-off. I think the Passport is worth about $ 500 in cash. BOTH my husband and I have terrible credit & debt (see below as to why) and I need to get a loan (I can afford $ 250-300/mo. payments on a loan.) So, with these details, are there any lenders who will loan that amount? SERIOUS ANSWERS ONLY, PLEASE!! OUR BORING STORY: Here's what happened: My husband was a kid when he divorced, he did not hve an atty. & he signed away his life because he knew no better & never knew until now that he could modify the child support amount, etc. When divorced, "reasonable visitation" was ordered (7 yrs. ago) but his ex will not allow him to talk with or see the children. She is actually in contempt but that's another story. The ex wife had my husband paying 30% MORE child support than guidelines require. He should have been paying $ 229 - $ 280 based on his income. he earns $ 1,800/mo. His ex earns $ 80K + a year. She tricked him into paying $ 540/mo. in support then didn't allow him to see the kids. That said, he paid that crazy amount of support until he became unemployed in 2008 and he was NEVER behind until now. When he became unemployed, he could only afford to send $ 200 - 300/mo. instead of the $ 540. He would call the county & the state and he was always told, "Don't worry, just send what you can on a consistant basis," which HE DID, SO HE THOUGHT HE WAS DOING THE RIGHT THING! All of a sudden he received a contempt letter. Of course he knew he was behind, but he thought that since he spoke with both the county & the sate of SC, that he was okay and that he would not be thrown in jail because he WAS still consistantly sending at least half of what was due. He filed for a modification 2 times over the last year once I realized what was going on after I looked at his divorce papers. he had moved in with me, because he could not afford to live anywhere that didn't have RATS and BUGS and sometimes could not buy fod because of this high support. I am NOT kidding!! I saw where he lived. So, since he was sending away 1/3 of his GROSS income, after taxes, and after his student loan payments, he was left with about $ 20 a month for food. Living in the rats... So after I saw this, I helped him file for the reduction after I saw his papers when he becme unemployed. NO HEARING DATE WAS EVER SET! WHY? BECAUSE HIS EX-WIFE'S BEST FRIEND IS THE CLERK OF COURT IN THE COUNTY IN WHICH THAT CASE IS A POINT OF INTEREST. NICE, HUH? So, he applied for Legal Aid but we live in FL and that case is in SC so no help, there. he has to handle it all himself because attorneys all want $ 5K upfront. IF WE HAD $ 5K, THEN HE WOULD NOT BE IN ARREARS AS HE PRESENTLY IS! (DUH...) So, that is why he is in arrears; he did not know that anything could be modified and he was paying what he thought he was supposed to be, as told by the State. On a consistant basis. Now, to keep him from being sent to jail, because if he goes to jail then he will not be able to run the business with me and therefore it will go under, we need a loan to be able to pay off the arrears. See, he's NOT the deadbeat dd, he is the type of dad who wanted to see his kids, crying on their birthdays and all holidays because he could not speak with them because of a vicious ex-wife...having his Christmas toys mailed back "return to sender..." and, the fact that he has been consistantly paying and WANTS to work to continue to pay--but we have to avoid jail, now. To avoid this, I have to come up with the entire arrears amount immediately. ((I can't believe they treat fathers this way: he paid every penny of that ordered $ 540 for 6 years until becomming uneployed, then he reported his unemployment & ws then told to "just keep on paying what you can, consistantly." he did... Now theyre trying to throw him in jail!? Best answer:

Answer by PooPooLaTrash
Here is the reality check. People with excellent credit ratings are having difficulty securing personal loans. People with bad credit simply cannot get them, not with an interest rate that is anywhere near reasonable. The scammers on Yahoo answers are going to come out of the woodwork to reply to you, but be assured, they are NOT legitimate. All they want to do is relieve you of your money (most request a "downpayment" of some sort, or want you to supply all sorts of personal information you should not be sharing). Child support is an inescapable debt. Even bankruptcy won't absolve your husband of his responsibility. Your best bet is to go back to court and see if you can get a child support modification to a lower amount, but that will be based on his income and not the expenses of his second family (you and any children you may have). It's a hard truth to face, but you have to be realistic about this. If you would find a legitimate place that would loan you that much money unsecured, the interest rate is going to be astronomical and you're going to wind up owing several times more in payback than the original loan, meaning you'd be paying back for decades. And your husband will still be obligated to keep up his support payments.

Can my spouse continuously enter home after Exclusive Use has been granted?

Question by : Can my spouse continuously enter home after Exclusive Use has been granted? My divorcing wife and I own a home together in Wisconsin, after Temporary Order Hearing I was given Exclusive Use of the home & placement of the kids. My wife entered the home continuously for the first couple weeks retrieving property. Though a bit excessive (grabbing one item at a time), it was necessary for her to get her stuff. Two months have passed and she still walks in the front door unannounced & uninvited, I wrote her a letter explaining the disarray it creates with the kids and to please stop doing this. She then told me the bank said if the title & loan still have her name on it, she may enter anytime she wishes. I then talked to the Court Commissioner's office about this and they told me I could call the police but there was nothing they would probably do since they don't like getting involved with divorce cases, she also told me they [Commissioners Office] can't give legal advice to if she can or can't enter. I understand I should seek legal council, but in my situation I had to "act now" despite my financial situation. Supporting the kids, maintaining the financial obligations & paying her maintenance I have no money to hire an attorney. I have searched for the answer greatly, but can't find anything post temp orders defining this topic. I just want to know, can she enter uninvited despite me getting Exclusive Use? Please help, thank you. Best answer:

What is your best advice to parents and kids of a divorce for what they should and should not do?

Question by : What is your best advice to parents and kids of a divorce for what they should and should not do? If you could have told your parents what they should have done and should not have done when you were a child of divorce what would it be? If you were to give your best advice to the kids about to go through it what would that be? Best answer:

Answer by sheloves_dablues
Deal with your own marital shi1t. The kids didn't create it, nor can they fix it. Divorce if you have to but leave the kids out of it. Mom and dad aren't doing this "to" you, they are doing it "for" the family.

How can I get the court judges to make my X husband follow the court orders of our divorce decree?

Question by aneagle_whensheflies: How can I get the court judges to make my X husband follow the court orders of our divorce decree? Child Custody--I have full custody of all 5 of our minor children. Vistation of Children--He is to visit from 12 to 4 on Saturday's or as we mutally agree! He is to pay $ 375.00 per week support for me and the children through the Child Support Bureau. He is behind over $ 61,000.00 in child support! The Child Support Attorney for my County in Ohio requested the court impose the 30 days of suppended jail sentence but on the date that the imposition was to be heard he filed a motion to request emerangecy custody of 3 of the 5 children. Even though he mutally agreed that 2 of the children could reside with him; and were; they all had been going to the same school since November of 2005. Because I was the guardian and residential parent all 5 Ohio law requires that all go to the school the custiodian and or guardian resides in. The decree has been final for over 2 years but he doesn't want to go to jail so he is filing everything. How does vitims of abuse get stability when judges do th> Best answer:

Answer by kneppermike
I am not familiar with the Child Support Enforcement laws in Ohio, but apart from criminal solutions (which is what the prosecutor will be doing) you may look to some civil solutions. You should look to modify your divorce/custody agreement to reflect our current situation. I am not sure about your particular area, but if you dont have legal represetation at the current time you really need to get it. As a victim of abuse, depending on your income level, you may be eligible for free representation from a Legal Services facility in your area. You should be able to find their number in the yellow pages or by running an internet search for "Legal Services" in your area. As for child support, it depends on whether he is simply not paying, or whether he is not working. If he is to go to jail, this will provide the state with an opportunity to organize and hopefully enter a judgment whereby his wages can be garnished. You really need to get legal representation if you do not have it already.

Filing a divorce without an attorney?

Question by Darko: Filing a divorce without an attorney? So I have this friend who has been married to the same guy for 11 years. I recently lost touch with her and just saw her for the first time in 5 years about 2 weeks ago. She spoke of how she just had to have a breast removed from cancer, and then started telling me about her problems at home. The guy she's married to refuses to offer her any money to do anything. As opposed to staying at home and healing well, she's been doing small cleaning jobs for $ 50 a day even though she only came out of surgery about 3 weeks earlier. He refuses to give her money for food, or to buy her children things they need. Recently he took the stimulus checks the family received and spent them on what we presume to be pot and a new fish aquarium. My questions is, she desperately wants to divorce him or separate from him so she can have him removed from the house. A lawyer said he needed $ 2k. Are there any easier ways to do things? We live in Ohio. Best answer:

Answer by granny
There are paralegal offices that do flat rate divorce papers for $ 500.00. They fill them out for you, but you still need to take them to court yourself. You will represent yourself instead of an attorney. The office will tell you what packet of forms you need.

Q&A: Is Barack Obama and David Axlerod behind the Cain smear campaign?

Question by Texas Patriot: Is Barack Obama and David Axlerod behind the Cain smear campaign? I found out that Herman Cain has never lived in Chicago and yet all the accusations of sexual harassment have come out of Chicago. Sheila O'Grady, who went from being former Chicago mayor Richard M. Daley's chief of staff to president of the Illinois Restaurant Association (IRA), is also an associate of Axlerod and is suspected of being the one who got Cain records from the NRA of course she denied it. The new accuser lives in the same building of Axlerod in Chicago. The only reason Obama became a US Senator was because the media smeared his opponents. At that time Axlerod worked for the Chicago Tribune which was the newspaper that started to release claims against Blair Hull, Obama's opponent in the Democratic Primary. They claimed that during their divorce Hull's wife had to sought get order of protection against him. Hull's then ex-wife came forward and said none of it was true but the media continued their attack and eventually Hull's lead over Obama evaporated. In the general election Obama's opponent was Jack Ryan who was married to Jeri Ryan. In a child custody dispute some years earlier, Jeri Ryan, had alleged that, while the couple was married, Jack had taken her to swingers clubs in Paris and New York, a charge denied by Jack Ryan. In an effort to protect their son Jack requested the divorce records to be permanently sealed. Axlerod had his moles, who worked in the courthouse obtain the sealed records and passed them out to every political operative in Chicago. Chicago Tribune attorneys flew to California and requested that the court officially "unseal" them -- over the objections of both Jack and Jeri Ryan. The judge ordered them unsealed and well, the rest is history. It's obvious Axlerod has a history of smearing political opponents and in Cain's case it looks as though Chicago is involved again. Is Barack Obama and David Axlerod behind the Cain smear campaign? Alimony Alimony is often an issue in divorce when one spouse has financially supported the other during the marriage. Usually, the dependent spouse must prove that he or she is the dependent spouse and that the other spouse is the supporting spouse. There is no legally mandated amount concerning the amount of Alimony awarded. In North Carolina, adultery or illicit sexual behavior can impact the outcome of Alimony. If the dependent spouse committed the act, the court must deny the Alimony claim. If the supporting spouse committed the act, the court must grant the Alimony claim to the dependent spouse. If both parties committed adultery, the court must decide. The video covers more details but is NOT meant to be an all inclusive overview of Alimony. My ex-wife got pregnant by another man before we were divorced. I live in NC.?

Question by : My ex-wife got pregnant by another man before we were divorced. I live in NC.? We separated in March 2009, got divorced in Aug 2010 and she had the baby in Jan 2011, so she was pregnant at the time of divorce but the divorce papers make no mention of it. I just found out about this and don't have all the details but apparently she and her boyfriend are working with an attorney to get it straightened out. I haven't talked to her since our divorce and I am now remarried. I read a few other posts on here about who's name is on the birth certificate and saw a lot of different responses. Could my name be on the birth certificate? How could that be? I am 100% sure the baby is not mine, as I have not even seen my ex since like April 2009. Supposedly I am going to get some sort of document to sign to get everything straight. But I'm not even sure what all is going on. I found out about this today through my ex-sister in-law and she doesn't know all the details. And I refuse to talk to my ex-wife unless a court is going to make me. Needless to say my current wife is really confused and upset. Anyone in NC have experience with this kind of thing??? Is this just an administrative thing or do I have other things to worry about? Of course I do not plan on signing anything without a lawyer looking at it first. Judging by the time line, the baby was apparently conceived prior to our divorce being final but, born after our divorce. From what I can gather, both my ex-wife and her boyfriend want this to be corrected and the boyfriend is not making any claims that he is not the father. He does not want me in any way involved, nor do I want to have any involvement. I am hands down not the father. I just can't figure out why there was no mention of pregnancy in the divorce papers (if she had the baby in Jan 2011, assuming a 9 month pregnancy, surely she would have known she was pregnant in Aug 2010!). And how in the hell could my name be on the birth certificate? Best answer:

Q&A: Answer my question please. House mortgage. Probate court???? Help!!!!?

Question by Teresa E: Answer my question please. House mortgage. Probate court???? Help!!!!? Question for an attorney, lawyer, judge, or homeowner ....or anyone familiar with this situation. I am clueless. Long story short, I have bad credit. Looked into buying a house in SC. Man seen my credit was bad and helped me buy his house by using his lawyer. We went, got a signed contract, with all the payments marked out month by month. I am to own the house in about 11 years after the start of the contract. He still owed on the house and doesnt have the deed yet. I was helping him so he didnt have to pay 2 house mortgages and he was helping me get a house all though i had bad credit. but basically he owed exactly what he was charging me for the house. I would pay him, he would pay the bank, and thats how it worked for the last 3 years. Well now, he has passed away. Sitting in the lawyers office in front of the lawyers he told me, to not worry about when he dies cause he was elderly, his daughter would then start taking the payments and paying them for me. Once I furfill my aggreement the deed was to be turned over to me. He said his daughter was as kind and understanding as him and that they are just glad we could all help each other. I've been paying his daughter for 6 months now. This month she sent me a letter in ther mail saying "all my fathers assets will be turned over to probate court, i hope the judge is a leaneant on you as my father has been". Whatever thats suppose to mean, considering the facts that the house was overpriced, high interest rate, and needed several repairs that i was unaware of before purchasing such as one very pricely expense.... all wiring needed replaced. I have always paid her father and always paid on time. I even pay $ 50 to him a month so he could continue to keep the insureance on the house that he had purchased for it. Also i have added an addition and a privacy fence that cost around $ 15k, only becasue I thought this was my house for good. Basically i need to know what probate court is going to do? is the $ 4000 down payment and $ 30,000 ive already paid just my loss? What about the contract agrrement signed by the lawyers that say i will own the house in 8 more years if i pay monthly? I cannot get a loan to pay off the house. i cannot get it in my name or finance it. I have bad credit that stems back to hospital bills when i was a child and credit cards issues from college years. What do i do now? I am a single mother of three kids, going thru a divorce, and I would have never paid $ 1000 a month and a down payment unless I thought we were going to own this house one day. Do I pay next months payment? How do I know if she has been giving my $ 1000 each month towards the house loan? help! i feel suckered and as if Im going to have to come up with moving cost. I feel as if I am outta of $ 50,000 that I could have used for college, kids college, anything sides rent. I would have not paid a down payment and those large payments, those interest rates or the addition money if I was just renting. Best answer:

Answer by wizjp
Problem here sweets, is that once he died, the probate court has to decide what to do with his assets and debts. If he had an open mortgage on the house, it probably has to be sold to pay it off. The lender has no obligation to let the daugher take over payments to keep your agreement. With a good lawyer and a really good land contract, you may be a secured creditor against the estate for at least some of what you paid. Biggest thing people forget when entering into a land contract is that over 20-30 years, people die. When entering one, a lawyer needs to take all this into account as well as default provisions by either party; generally a good idea for BOTH parties to carry life insurance naming the other as beneficiary with the buyer picking up most of the premium; and getting the property on the death by paying off the note with the policy. Get a good lawyer; a different one.,

Ex-wife says Tea Party congressman owes $ 100,000 in support CHICAGO | Thu Jul 28, 2011 6:25pm EDT (Reuters) - A Tea Party-backed U.S. Congressman who has lectured the U.S. government about getting its financial house in order owes more than $ 100,000 in child support payments, a lawyer for his ex-wife said on Thursday. Illinois Rep. Joe Walsh, who was narrowly elected in a Chicago suburban district during the Republican sweep of 2010, denied the allegations and said he would fight them in court. His ex-wife Laura Walsh failed to receive full child support for about five years from 2005 to late 2010, her lawyer Jack Coladarci told Reuters. Walsh resumed full payments to support their three children after he was elected to the Congressional seat, which pays a salary of $ 174,000 per year, the lawyer said. "These latest attacks against me are false and I will fight them in the appropriate venue," Walsh said in a statement on his web site, referring to the Cook County courtroom where Laura Walsh brought the case. The divorce documents detailing the apparent delinquent payments were first reported by the Chicago Sun-Times. The attorney for Laura Walsh said the congressman needs to make good on the $ 117,437 he owes, plus interest. "Laura is getting help now because he has a job where we can find him," Coladarci said. "But it is difficult to raise three kids, and she is not remarried, and she is supporting them basically on her salary." The case focuses on unpaid child support between November 2005 to roughly December 2010. During that period, Walsh made partial payments between November 2005 and March 2008, but stopped in April 2008 and did not resume payment until he started to receive a paycheck from the House, Coladarci said. The suit also alleged that Walsh and a girlfriend took international vacations while Walsh said he was too broke to pay child support, Coladarci said. Laura Walsh filed for divorce in December 2002 after 15 years of marriage. The case alleges Walsh paid $ 1,000 a month short of his commitment for 28 months during November 2005 to March 2008. Walsh allegedly paid nothing from 2008 until resuming in late 2010. His ex-wife has asked the court to garnish Walsh's wages. The 49-year-old Walsh called himself "the tip of the spear" in the fiercely partisan debate over how to avoid a U.S. default on its debt. Tea Party supporters want deep government spending cuts and some oppose raising the nation's ceiling on debt under any circumstances. Walsh has repeatedly excoriated U.S. President Barack Obama and Democratic lawmakers for what he deems profligate spending. "I won't place one more dollar of debt upon the backs of my kids and grandkids unless we structurally reform the way this town spends money," Walsh said in a policy video directed at the President entitled 'Walsh to Obama: Quit Lying.'" It is never a good idea to trust what the media says about these things as they tend to not report the whole story. They do not report when the arrears were a result of retroactive child support and that anything paid without a court order, up until a child support order is put into place, is considered a gift. Also, how much of it is interest penalties, which can quickly double and triple the amount owed. People need to learn that the only real truth is when you go, or have someone, go and actually read case files. I do not care for the Tea Party movement as it is likely a front for rich people, just as it was over 200 years ago. However, liberals inflate claims about child support just for the purpose of bashing and diminishing fathers. It is a big game led by the President who blames men for fatherless children, while denying them the right to see the children when because the Gatekeeper mother does not want it, as happens to to over 20 million divorced and single fathers annually. http://squidoo.com/ChildSupportRetroactive http://divpat.org/YR-ChildSupportArrearsSoHigh ♂♀

Question by cardsrvc: PA Child custody before the judge and who pays expense? In the State of PA, would a judge hear a set of 12 & 14 year old children express which parent they choose to live with? Also, since during the divorce over aprox 7 years ago, the ex husband paid for the divorce (on both sides and is solid broke as a result today). In reopening the custody case, being broke, who would pay for the expense for the ex-wife's end. also, would there be any assistance for him in paying his share? Have you been to court and the judge signed the divorce decree? If so, then yes, you are legally divorced. It doesn't matter where you got married, where you got divorced, or who has (or has not) paid the lawyer.
