Question by meorfexman: How do I go about divorcing my wife is she has abandoned us and married another man? God this sounds like a white trash reality show. Okay, here goes. Twelve years ago my wife got into legal trouble, and vanished. Five months ago she reappears in Kentucky married to another man. I had tried to divorce her in PA but because I was former military I had to have her signature on one paper. I could have waited 2 years without filing and then divorced under the abandonment clause but I did not and so was stuck in that loop. Anyway, flash forward ten years, and I am now living in Oklahoma. She pops up out of no where to be part of our sons life again though she is living in Kentucky. All I have for her is a phone number. Turns out she is married to another man. I recently have met a wonderful young woman from Asia that I wish to marry but I have to show proof of divorce from my ex. I asked her if she had such proof since she has remarried and she does not. So I asked her if she would sign divorce papers, and she refuses to do that. She does not want anything money or visitation wise she is just refusing to be spiteful; to prevent me from remarrying. So, I just need to know from some one that does know how do I go about getting her out of my life? I have asked an attorney, and they say it can be done for an ungodly amount of money but I do not feel as if that is fair. I mean, she is already married, and we have not seen her in 12 years. I could help you, as I successfully defended myself in my own divorce. My wife spent 15k for her lawyer, and I spent $ 135 total. I won, and she even had to reimburse me for my $ 135. All you really need is someone who could guide you through it, as on first glance it seems like a tremendous effort. It's not that tough, so keep your chin up. Good luck...

When I hired a friend of mine to work for my company she started sleeping with my husband, I went to Orlando for the week-end and came home to him telling me that Barb had moved in and I could stay if I wanted. Needless to say I left and left everything there. Because of the business I cannot get a divorce I can afford, every attorney wants $ 20,000 retainer and since I do not get any funds from the business I cannot pay for it. He doesn't want the divorce because Florida is 50/50, I have tried everything, women's right's groups, legal aide, just a plain divorce and give him everything, still he refuses to pay for the divorce or even go through with it with me paying. I am sooooooooooo frustrated and soooooooooooo upset after all these years, years I have actually lost, could not meet anyone else and love them or marry them, I'm still married. I live in CA, but 2K is extremely low for a divorce with child and assets. I'm not sure how much luck you will have, but try to contact the Florida Bar Association http://www.floridabar.org/ and they might be able to help. Also, you might have a legal resource center in town, which could help you at a cheaper rate. Good luck.

In order for an Attorney to represent you formally in any matter, they must fill out an appearance form, a form that puts the court on record that the person is represented by counsel. Since you do not have to have an attorney at the beginning of a divorce, an attorney can file an appearance at any time. If you are going in front of the Judge without an attorney, many times the courts will have you sign the appearance slip.

Question by FionaLeona: I'm searching for a legal aid lawyer in Kentucky (divorcing military emotionally abusive husband)? I'm trying to get away from my emotionally abusive husband here in Fort Knox. I've sought help through family advocacy and they have him in counseling. He's still acting up. I've contacted the mp's several times and they had us both sign a document that if we have another altercation we're both to leave housing as we live on post. I can only report him to our counselors but they've only suggested I learn to live with him until he's finished counseling. I can't deal with this anymore. He accuses me of stuff and pulls our daughter in the middle of his berating me and causing arguments. I'm so tired. I've contacted legal aid here in Kentucky (I can't afford a lawyer he's the one with the income) and they tell me that they have no services here in Fort Knox for the next couple of months. I went to the court to file divorce papers myself but they won't allow you to file without a lawyer because they don't have pro se' divorce papers, you get them from your attorney. I want him out of the house to give us (my daughter and me) some relief. I'd love to leave and take my daughter home with me to my parents until I find a job in Chicago but they have a law here that prevents a parent from taking the child out of state when both have joint custody. Is there a way to get around this? Is there anything I can do? He starts arguments and when I try to leave the house he follows us to the store, he hides my clothes and important documents, takes away my cellphone and internet service so I can't contact my family. He will take my daughters pictures and pretend they are hidden and tell me that I've lost them, things like that. He told my daughter I don't want to feed her if I ask him to pick up something from the grocery store, he tells her and other people that I'm trying to turn her against him, but she sees him doing all of these horrible things. I didn't misunderstand. I was told that there were no pro se' papers and was strongly encouraged to get a lawyer. I don't have lawyer, this is the reason for me seeking to file alone. The clerk told me I'd have to find a way to get the papers to file myself. Best answer:

Go back to the court house. You misunderstood, because of COURSE they have 'pro se' paperwork. It is logically nonsense to say you get pro se forms from your lawyer.

Power of Attorney how does it works in the state of Florida!?

I know someone who is getting a divorce, but has a car under the persons name that's in jail but no name what so ever of the spouse, if he/she signs Power of attorney from a police station can he/she girlfriend/boyfriend get the car, instead of the spouse, in the state of Florida? My friend tried to use the power of attorney for the bank and they told him/her that it wasn't* accpetable because they're isn't 2 witnesses. What should he/she do, can she/he still get the car? Note*** The Power of Attorney from the police station has only he/she info no 2 witness signatures. What if the he/she that he is divorcing wont give the car to the person who has power of attorney that's only under the inmates name and not the spouses. Best answer:

well my POA only has my sons signature and my name plus the lady that witnessed it, I think the sticky part of your story is that until the divorce is final then the goods are seen as joint property and that does not mean him and the gf.............Is the car in joint names?? ie the person and the spouse as co owners???

well that is a hard decision. First of all marriages don't fail because of one person, and you have to give up everything and move to Florida? No way. I think you need to serve him with the papers, maybe it will serve as a wake up call. If he wants to work it out with you, go to marital counseling, and he needs to realize partnerships fail because of two people, not just one. Plus he left and moved how many miles away? Question by bob: Can I force my husband to move out of the house, we live in PA? This is an awful marriage. Marital therapist advised me to get a divorce after 9 months of unproductive marital sessions. Hubby has not slept w/ me for 6 years. When I discuss divorce he tells me to figure it out on my own and get out of the house. Our two children have medical conditions that require a specific environment that is very expensive to supply. The home we are in has been custom built to meet their needs so moving out is not viable at this time. Furthermore, hubby could not possibly take care of our children's needs so having them live with him is not a consideration. THe bottom line is hubby knows I will never compromise the kids' needs so he acts like he has me by the throat. This is just what he likes...he is a major control freak....HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Please give answers beyond suggesting I need to hire an attorney....I know I need to do that and am scheduled to do so. Thanks! I dont have any answers for you but I just want to say...you are amazing for putting your childrens needs first. Some things to consider...who paid for the house? Whose name is it in (or is it in both your names?) can the environment your children need be set up elsewhere (like at a parents or friends home?). If he has ever threatened you physically, I wouldnt hesitate to call the police on him. A record of his behavior will go a long way.

In response to my question earlier about how someone like former Governor and former Attorney General of New York Eliot Spitzer could want the U.S. to depart or divorce from Pakistan and to let Pakistan get close to China, I've been told that the U.S. has always wanted for Pakistan to be close to China. Why would that be? And supposedly this has been going since Nixon was in power? To me this is a dumb movement, especially now that China might be suspicious of the U.S._what am I saying? Every nuclear power is afraid of one another! But really, I do hope that this is only Spitzer's dumb idea and not anyone in the state department. If we can't trust Pakistan now, mainly supposing that they knew about Bin Laden, and this is the most convoluted thing to come this way for a few decades. Question by irina p: What should the wife do if she got divorced without her knowledge? Husband left his wife in PA and married another woman in FL. He filed for divorce in FL from his first wife. She filed an answer where she did not agree with some of the terms of the divorce. Therefore they were scheduled for a conseling. An agreement was not reached so the case was forwarded to a case judge. A few months later husband asked a judge for a continuance on the case due to some health issues. The copy of that letter was forwarded to the proper address of his wife in PA. Soon after that the wife in PA recieved another document (now sent to her old address) from FL court with the ruling that the divorce was granted because she did not show up at the hearing. What hearing? She never recieved any notice from FL about any court date. Therefore is this divorce legal? By the way, the husband is a con artist and has a warrant for his arrest in NJ, so, he could forge easily her signature. Florida Court clerks were even informed by PA Attorney General Office of husband criminal character and yet they chose not to inform the judge? What is wrong with that picture? Or may be there is something I don't undestand here? What can be done now? Any ideas? Thanks. This is not my story. I just want to understand how come some people can break the law and get away with it? The husband is in his 60th and so his first wife. He took some of her things and left her a ton of debt. Look for a new husband. Why would anyone contest a divorce from the type of person you described? You can't force someone to stay married any longer. let him go.

Question by : so my dad molested me when I was 5-10? my dad molested me when I was 5-10, I moved when I was 11 but I was never home when I was ten so it stopped, I am now 17, and since I moved when I was 11, my parents seperated, but are not divorced to this day.I am wondering if I can put him in jail by going to the court and talking to someone, I can't get an attorney because I have no money, and he also hasn't paid child support to me since I moved when I was 11. He refuses to send me any money, but he lives in chicago and I live in california. What is the first step I need to take. I want him in jail for what he did to me, but I also really need the money! I start college soon and need a lot, but he now has another family (he is still married to my mom btw) and he has a baby on the way with his girlfriend who has two children under 14 years old. You need proof that he molested you. You need to talk to family services about the child support thing. You can't just go to a court room, and sometimes you can just call a family attorney, tell them your situation and they won't make you pay anything until you have won your case. Call and attorney, most will gladly steer you in the right direction.

(Culled from a blog) A principle of law espoused by Benjamin Franklin, is that it is better that one hundred guilty persons should escape than that one innocent person should suffer. Others such as Pol Pot believed the unjust punishment of innocent citizens is inconsequential so long as the guilty do not escape. A bill before the New York State Assembly, which reportedly has wide support, would require every individual subject to a restraining order to wear an electronic monitoring device so the state can track them at all times. Leaving aside fears of a coming surveillance state, the proposed legislation ignores a fundamental problem with DV restraining orders – the large number of them that are unwarranted. Considered in conjunction with the low standard of proof required for issuing a restraining order, this proposal does such violence to the principles of due process that it undermines the very foundation of a free society. The restraining order process circumvents the ordinary protections intended to protect the innocent. The standard of proof is not "beyond a reasonable doubt" but merely "a preponderance of the evidence". A restraining order is issued if a judge believes there's a 51% chance that the accusation is true. Not long ago, the accusation of a deluded fan who thought NY resident David Letterman was harassing her telepathically was sufficient for a judge to issue a temporary restraining order against him. For anyone without Letterman's resources, the temporary restraining order would almost certainly have been made permanent. A great many people targeted by restraining orders are not the monstrous brutes Hollywood would have us believe, but are rather innocent victims of the scorched earth tactics that are all too common among divorce attorneys. In the Illinois Bar Journal, attorney Thomas Kasper speaks of restraining orders being used as "part of the gamesmanship of divorce." Elaine Epstein, former president of the Massachusetts Bar Association, has warned, "Everyone knows that restraining orders and orders to vacate are granted to virtually all who apply ... In many cases, allegations of abuse are now used for tactical advantage." But surely judges who are sworn to uphold the Constitution will give the accused a fair hearing, won't they? Consider this – How fair a hearing can one expect from any judge who's been through a training like the one in which the instructor, Judge Richard Russell, was caught on tape telling family law judges: "Your job is not to weigh the parties' rights as you might be inclined to do. Your job is not to become concerned about all the constitutional rights of the man that you're violating as you grant a restraining order. Throw him out on the street, give him the clothes on his back and tell him, 'See ya' around.' ... we don't have to worry about the rights." How many other trainings like this, that weren't caught on tape, have polluted family law judges' concept of justice? Less than half of restraining orders involve an allegation of any violence, according to a study by the Massachusetts Trial Court. RADAR estimates that in the U.S. every year, half of the roughly 2-3 million restraining orders issued are not based on even an allegation of physical violence.4 Thus a great percentage of restraining orders are issued against innocent people. And now the New York State Assembly wants to require all those innocents to wear an electronic monitoring device 24 hours a day, and no matter how uncomfortable these devices are, if they should "tamper" with it in any way they'll instantly become felons. New York legislators face a stark choice: fashion New York law according to Pol Pot's vision or according to Benjamin Franklin's. Question by My baby girl, isn't a baby anymore: Can a Notary Public refuse to notarize certain types of documents? I'm just wondering, as a notary public, would I be able to limit the types of documents that I want to notarize? For example, if someone comes in and wants me to notarize a deed of some sort, lets say for the transferring of property, which I will be honest I have NO CLUE how any of that works, could I suggest that they get an attorney to notarize it for them? I would prefer to not notarize things of that nature. As a notary all your seal means is that you have verified the parties have signed the document. Period. You are not a lawyer. It's not your job to give legal advice or make legal decisions. That being said, you're a free agent. If you don't want to seal it; don't. No law says you have to seal anything you aren't comfortable with.

Twenty-five-year-old Jessica Vega is facing multiple felony charges after she allegedly faked a case of terminal cancer in order to get a free "dream wedding" and honeymoon. The Times Herald-Record reports New York Attorney General Eric Schneiderm announced on Monday that an Orange County Grand Jury has indicted Vega on five counts of grand larceny and one count of scheme to defraud. Vega, who had been living in New York until the indictment, has been extradited to authorities in California. "By pretending to have a terminal illness, Vega inexcusably took advantage of the community's hearts and minds, and profited off of their generosity," Attorney Schneiderman said. "Our office will hold this individual accountable for fleecing the public through lies and deception." In 2010, Vega claimed to be dying from acute myeloid leukemia and wanted to marry fiancé Michael O'Connell, the father of her child. Friends, family and total strangers rushed to support Vega, giving her a $ 1,200 wedding dress, wedding rings and even flowers for her wedding reception. The couple was then treated to a free honeymoon in Aruba. However, it appears O'Connell was not in on the alleged fraud. When he contacted Dr. Dan Costin about Vega's treatment, he was told she had never been a patient. O'Connell then reached out to the Times Herald-Record to explain that the illness was likely a fake. The couple was divorced shortly after Vega was exposed. But in an even stranger twist, the couple is now once again reunited and has had a second child together. "She's a good mom, and that's all that counts at the end of the day," O'Connell told the paper. "I want my kids to have their mother back." He said he thinks the best course is for Vega to repay the wedding donors and seek mental health treatment, rather than jail time. We are currently living in New York City. I want to file for a divorce as soon as possible due to incompatibilty and growing difference between us. Question by little laho: How to remove Lis Pendens lien against real properties in California? My wife's attorney has filed the "notice of pending action" also call "Lis Pendens" against my solely own properties because of the divorce peition filed last year. We are now getting back together and decided to withdraw the divorce petition, however, the "Lis Pendens" is still effect and shows on the county clerk office. Does any knows how to "remove" or expunge it? I am in Los Angeles CA. Thanks.- Best answer:

well the only way to do that is to either sell them or to buy your ex-wife out or that you guys come to an agreement on your guys own like every other month one of you gets the rent money with the understanding that whoever gets it has to pay the morage for that property or the next best and easiest thing to do is to split the properties evenly like give her some and you keep some then you can show the judge that you both have an equal amount or get a really good lawyer GOOD LUCK

Question by Eddie: living with my dad please help!? ey guys i have another question. ok so look , my dad just looked at the divorce papers and all tht legal crap and it says he has had visitation rights 2 see me every sunday since april 2002! my mom hates the guy and made it seem like hes a horrible guy and trust me folks, hes not. well anyways i never knew he had those rights and even if i did i wouldn't have cared because i hated the guy 4 so lon but now i realize it was all lies and misconceptions. i really want to go live with him and since im 16 i have the choice of which parent i want to live with and i choose him because i really want to get 2 know my dad and have that special bond fathers and sons have. im currently living with my sister by power o the attorney and my mom has full custody i have been told that full custody is just there until im of age to choose what parent i want to live with. so i want to live with him back home in chicago. i just want to know if the court has anything against my mom giving me up 2 my sis without his consent because he has visitation rights. so will that matter in court? and do u think i have a good chance of being able 2 live with my dad? also there has been a couple incidents of abuse towards me from my brother and my sister im living with now. so guys please answer i really need ur help with this issue thanks guys take care=] also did my mom have 2 tell my dad about her placing me under care of my sis?? and does the court care about his visitation rights? will this be a quicker case because of his rights 2 see me? so many questions please answer guys again i really need u guys 2 answer me lol srry 4 taking up ur time thanx again Best answer:

If your mother sent you to live with you sister, and you want to live with your father and are willing to make court arrangements, there should be very little problem. If there has been abusive incidents, call CPS and report it. And call your parents and let them know. He should still have visitation rights, regardless of where you are living. But you need to go to court and speak up. Good luck.

Get yourself an ID. Take a bus to the MVA and get an identity card. Then go to the bank and take as much money out of joint accounts as you can. You need to get a driver's license, and job, and a spine. Don't just use excuses. Fight. Filing first means nothing. Apply at legal aid, but you probably won't qualify, as they will include your husband's income, because legally, it is yours also. Call your state bar association and see what referrals they can give you. As a last resort, call the nearest law school and see if they have any programs where a law student can handle your case while being overseen by a law professor. Some law schools have such programs.

Question by : my husband wants a divorce and is trying to take our nine year old away from me!? My Husband and I have been seperated for a month and yesturday i just got divorce papers from him along with other things he is trying to seek full custody of our 9 year old daughter, get me to pay child support along with having life insurance on me with him as beneficiary!! We split up because for the 2nd time he wants to take our daughter to new york on christmas...with him his father and stepmother. My husband has a learning disability and has his dad as power of attorney over him plus he does not even get his check it goes straight to his dad and his dad pays his bills. My husband is 40 and i am 30 and have been married nine years, He goes to a psyciatrist for is anxiety and anger problems but yet they say i am an unfit mother when i am the one that is always taking care of her , my daughter is everything to me, i have told my husband he could come over anytime and on the day i left i told him i am taking our daughter out of school and he said ok then after i left he lied to his dad and told him i didn't. I want to live my life the way i want it while my husband will do anything and everything his family tells him to do. On the last day I was there i heard his father say tell your wife if she does not let your daughter go to new york for christmas than you will not take her to see her mom or grandmother...my husband just told me..he did not defend me at all and they are making me look so bad even when i comprimised and said she can go a week before or the week after and they said no. I have always let her go see his realitives except on holidays i think the mom,dad and children should be together and wherever they go. They are saying i am making it hard for them to see her but i told them they could whenever, they said i am a good mother before now they are calling me bad...it would absolutly devastate me to loose my baby please someone give me advice it is not about just about chrismas i let her go last year and they said they would not take her again...it is mostly about him not being man enough to discuss things and decide how things are going to be done as a couple and then getting his whole family involed and getting into the middle of our marriage, i got married to him quickly...if i knew then what i know now...but then again i would not have my beautiful daughter/ they get involved in everything even going as far as telling me what to name our child and threatning to disown him if he doesn't Best answer:

Question by Cue Eo: Undiagnosed contagious skin disease---HELP!!!? When I got married my husband and I went to Chicago to meet his family. We stayed with his aunt and uncle. His uncle had some kind of skin disease, but they wouldn't say what it is. They told me not to use the black spongee/scruntchy in the shower. I did not associate the two right away, because we showered not long after we drove all the way there. He worked from the home, in the basement...they said where it is cool. And he could not got outside in the sunlight, or for very long at all. One day I accidently used his scruntchee shower thing. And I then got a very itchy painful burning prickly small blisters scabbing rash in the area that I used the scrunchee. I only used it for a few seconds then stopped and switched, and the symptoms appeared only where i used his. Believe it or not, my husband gasped when I showed him. Kicked me out and said he wanted a divorce, immediately. I went back to Cincinnati. They would not tell me what it is. They never did. I suspect because the Uncle is an Attorney. I went to the doctor several times, well the ER because I have no money for a dermatologist. They always just blew me off. Sometimes it lasts for days, sometimes for onlly a day or two. Sometimes it scabs, sometimes it doesnt. But it is definately brought on by heat light maybe sweating I have since changed my life, I do not go out in sunlight, heat, no tanning beds, I stay cool, I dont go anywhere warm ever. I am freaked out it will get worse and spread. It did spread to my upper shoulder once with my scruntchee awhile back. Although I have always been cautious not to use it on that area, and just rinse those areas instead. I will save and go to doctor if I can NAME or make a good guess as to what I was exposed to, otherwise they say hives-look at me like im crazy, dont even look at the rash and send me away. They dont believe my story. I think someone said he got it when he was in vietnam or something, im not sure. That may not be a clear memory. Can anyone help me? When I get married again I would have to live in a hot climate, I may have to say no if I cant get this straightened out/treated/prevented. Thanks once again...any clues or guesses will help. if i spend months saving to see a dermatologist i dont want to get turned away with no answers just because he cant see it. the family will not tell me. seek out a professional or something I have no idea what this is, maybe you should try talking to the "uncle" who has the disease, if you can even contact him/them I would do whatever possible just figure it out, it sounds very serious.
