Which state to file for divorce in and is it required to have an attorney?

Question by armyandreamariewilliams: Which state to file for divorce in and is it required to have an attorney? A man and woman were married in Florida and they had a minor child. They have been seperated for over 4 years now. The man lives in TN and the wife and child in FL. He has been paying child support the entire time. They agree on everything but visitation. She doesn't want the minor child to go to TN where the father resides for visitation ever. The minor child is about 5. Does the man need to file for divorce in TN or FL since he is no longer a resident of FL? Does he need an attorney because he really can't afford one? How does the man go about getting visitation rights? He can not afford an attorney because he does not make that much and he barely has enough to live off of after paying child support. Best answer:
