Question by Stephie: Served ex with divorce papers, how long can he stall? I had my husband served with divorce papers, I live in Florida, he lives in New Jersey. There was a lot of physical abuse and now he ducks out on most of his responsibilities regarding our children. He answered the petition a day late (fla. gives 20 days) and now his attorney says he needs time to collects his papers etc. How long can he realistically stall. He is not battling for the kids just child support. Is there a standard time frame given before going for mediation/arbitration then judge??? Ps...we are both represented by attornies.

Hi, If you are not using an attorney, you probably should; the do-it-yourself kits are only good when everyone follows the rules. You need professional help when one of the parties decides they don't want to play by the rules. Looks like your husband wants to play this out. Get an attorney so that you are protected.
